brief statement of the essential features of the measure as
introduced.
 
  Authorizes Department of Human Services to establish medical
marijuana dispensary program pilot project. Creates oversight
committee. Authorizes department to adopt rules to implement and
operate pilot project.
  Sunsets project December 31, 2016.
 
                        A BILL FOR AN ACT
Relating to medical marijuana dispensary program pilot project.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2007 Act is added to and made
a part of ORS 475.300 to 475.346. + }
  SECTION 2.  { + (1) The Department of Human Services shall
develop and implement a medical marijuana dispensary program
pilot project to produce and dispense high quality medical
marijuana to registry identification card holders. The pilot
project shall be operated in partnership with the Oregon State
University Extension Service agricultural research program at
Hyslop Farm.
  (2) The pilot project shall develop an ongoing garden and
dispensary program. The dispensary program shall provide medical
marijuana to all registry identification card holders who elect
to participate in the program. Participation in the dispensary
program shall not infringe upon the right of a registry
identification card holder to produce medical marijuana as
provided in ORS 475.300 to 475.346.
  (3)(a) There is created the Medical Marijuana Oversight
Committee, consisting of nine members appointed by the Director
of Human Services as follows:
  (A) Four members who shall be registry identification card
holders under ORS 475.309.
  (B) Three members with expertise in horticulture.
  (C) One member who is a physician licensed under ORS chapter
677.
  (D) One member who is the person responsible for the financial
management of the Oregon Medical Marijuana Program.
  (b) The committee shall annually review the pilot project and
make a written report to the director about the progress of the
project, and to recommend the amount of fees that should be
charged participants in the dispensary program to offset the
actual costs of the program and any changes to the administrative
structure of the program that may be necessary.
  (c) The committee shall determine, in consultation with the
staff of the pilot project, the strains of marijuana to be
produced for the dispensary program and methods for testing the
quality of the strains selected.
  (d) A majority of the members of the committee constitutes a
quorum for the transaction of business.
  (e) The committee shall elect one of its members to serve as
chairperson.
  (f) If there is a vacancy for any cause, the director shall
make an appointment to become immediately effective.
  (g) The committee shall meet at least four times a year at
times and places specified by the chairperson or of a majority of
the members of the committee.
  (h) The department shall provide staff support to the
committee.
  (i) Members of the committee are not entitled to compensation,
but may be reimbursed for actual and necessary travel and other
expenses incurred by them in the performance of their official
duties in the manner and amounts provided for in ORS 292.495.
Claims for expenses shall be paid out of fees collected by the
Oregon Medical Marijuana Program.
  (j) All agencies of state government, as defined in ORS
174.111, are directed to assist the committee in the performance
of its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the committee consider necessary to perform their
duties.
  (4) Expenses of the pilot project and of the dispensary program
shall be paid from fees collected by the department for the
issuance of registry identification cards and for participation
in the dispensary program.
  (5) Any fees paid by participants in the dispensary program
established under this section are not subject to the prohibition
against exchanging marijuana for consideration established in ORS
475.316.
  (6) The department shall adopt rules necessary to implement the
provisions of this 2007 Act. + }
  SECTION 3.  { + Section 2 of this 2007 Act is repealed on
December 31, 2016. + }
