Chapter 16 Oregon Laws 2008 Special Session
AN ACT
SB 5556
Relating to state financial administration; appropriating money;
limiting expenditures; and declaring an emergency.
Be It Enacted by the People of
the State of
SECTION 1. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
community support established by section 2 (3), chapter 747, Oregon Laws 2007,
for the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts
and reimbursements from federal service agreements, but excluding lottery funds
and federal funds not described in section 2, chapter 747, Oregon Laws 2007,
collected or received by the Oregon Military Department, is increased by
$112,462 for reimbursement of firefighting costs incurred during the 2007 fire
season.
SECTION 2. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
emergency management established by section 3 (3), chapter 747, Oregon Laws
2007, for the biennium beginning July 1, 2007, as the maximum limit for payment
of expenses from federal funds, other than those described in section 2,
chapter 747, Oregon Laws 2007, collected or received by the Oregon Military
Department, is increased by $17,500,000 for pre-disaster mitigation grants and
chemical stockpile emergency preparedness program grants.
SECTION 3. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures for emergency management established by section 2 (5), chapter
747, Oregon Laws 2007, for the biennium beginning July 1, 2007, as the maximum
limit for payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts and reimbursements from federal service agreements, but
excluding lottery funds and federal funds not described in section 2, chapter
747, Oregon Laws 2007, collected or received by the Oregon Military Department,
is decreased by $3,201,465.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures for emergency
management established by section 3 (3), chapter 747, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from federal funds, other than those described in section 2, chapter 747,
Oregon Laws 2007, collected or received by the Oregon Military Department, is
increased by $3,201,465 for expenditure of United States Department of Homeland
Security grants other than those described in section 4 of this 2008 Act.
SECTION 4. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
emergency management established by section 3 (3), chapter 747, Oregon Laws
2007, for the biennium beginning July 1, 2007, as the maximum limit for payment
of expenses from federal funds, other than those described in section 2,
chapter 747, Oregon Laws 2007, collected or received by the Oregon Military
Department, is increased by $77,920,449 for expenditure of United States
Department of Homeland Security grants for public assistance related to
disaster relief and post-disaster hazard mitigation grants.
SECTION 5. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures for debt service established by section 2 (7), chapter 73, Oregon
Laws 2007, for the biennium beginning July 1, 2007, as the maximum limit for
payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal funds,
collected or received by the Oregon Department of Administrative Services, is
increased by $256,374 for renovations to the State Office Building in Eugene.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures for debt
service established by section 2 (7), chapter 73, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the Oregon
Department of Administrative Services, is increased by $178,302 for conversion
of data center spaces.
(3) Notwithstanding any
other law limiting expenditures, the limitation on expenditures for capital
improvements established by section 2 (4), chapter 73, Oregon Laws 2007, for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Oregon Department of Administrative Services, is increased by $567,000 for
projects on the Capitol Mall.
SECTION 6. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
operating expenses of the State Services Division established by section 2 (2),
chapter 73, Oregon Laws 2007, for the biennium beginning July 1, 2007, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Oregon Department of Administrative
Services, is increased by $3,600,000 for increased fuel costs for fleet
vehicles.
SECTION 7. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for other
operating expenses established by section 2 (3), chapter 73, Oregon Laws 2007,
for the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Oregon Department of Administrative Services, is increased by $2,155,000 for
the development of an online benefits management system for the Oregon
Educators Benefit Board.
SECTION 8. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for debt
service established by section 2 (7), chapter 73, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the Oregon
Department of Administrative Services, is increased by $498,205 for debt
service for the online benefits management system for the Oregon Educators
Benefit Board.
SECTION 9. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
operations established by section 4 (1), chapter 699, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from federal funds, other than those described in sections 5 and 10, chapter
699, Oregon Laws 2007, collected or received by the Department of Education, is
increased by $3,300,000 for a statewide longitudinal data systems grant.
SECTION 10. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for the
Oregon Wetlands Mitigation Bank Revolving Fund Account established by section 2
(5), chapter 107, Oregon Laws 2007, for the biennium beginning July 1, 2007, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of State Lands, is increased by
$1,500,000 for wetland mitigation projects.
SECTION 11. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 5, chapter 388, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, except those deposited in the
Multistate Tax Commission Revolving Account and the Senior Property Tax
Deferral Revolving Account, but excluding lottery funds and federal funds,
collected or received by the Department of Revenue, is increased by $1,317,835
for the administrative cost of calculating and issuing refund checks as
required by ORS 291.349.
SECTION 12. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2, chapter 728, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Department of Justice, is increased
by $343,596 for Oregon’s Terrorism Intelligence Threat Assessment Network
Fusion Center.
SECTION 13. Notwithstanding any other law limiting
expenditures, the limitation on expenditures for maintenance and emergency
relief programs established by section 2 (2) chapter 749, Oregon Laws 2007, for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts
and federal funds received as reimbursement from the United States Department
of Transportation, but excluding lottery funds and federal funds not described
in section 2, chapter 749, Oregon Laws 2007, collected or received by the
Department of Transportation, is increased by $2,000,000 for the purpose of
providing the state match to support a federal grant from the United States
Department of Justice, Office of Community Oriented Policing Services, for the
Oregon Wireless Interoperability Network project.
SECTION 14. Notwithstanding
any other law appropriating moneys, limiting expenditures or otherwise
adjusting appropriations or expenditure limitations, the authorized
appropriations and expenditure limitations for the biennium beginning July 1,
2007, for the Department of Transportation are changed by the amounts
specified:

SECTION 15. Notwithstanding
any other law appropriating moneys, limiting expenditures or otherwise
adjusting appropriations or expenditure limitations, the authorized
appropriations and expenditure limitations for the biennium beginning July 1,
2007, for the Department of Human Services are changed by the amounts
specified:

SECTION 16. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007, out
of the General Fund, the amount of $17,500,293 to be allocated to the
Department of Human Services for costs of increased caseloads and increases in
cost-per-case and for program needs.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 17. In
addition to and not in lieu of any other appropriation, there is appropriated
to the State Department of Energy, for the biennium beginning July 1, 2007, out
of the General Fund, the amount of $1,600,000, which shall be expended for
payments to help the Oregon Museum of Science and Industry with repayment of a
loan made through the Small Scale Local Energy Project Loan Program.
SECTION 18. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 16 (1), chapter 910, Oregon Laws 2007, for the biennium beginning
July 1, 2007, as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding lottery funds
and federal funds, collected or received by the State Department of Energy, is decreased
by $4,600,000.
SECTION 19. In
addition to and not in lieu of any other appropriation, there is appropriated
to the

any other law limiting expenditures, the limitation on expenditures established
by section 1, chapter 38, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the State Board of Psychologist
Examiners, is increased by $47,735.
SECTION 21. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
operations established by section 4 (1), chapter 699, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from federal funds, other than those described in sections 5 and 10, chapter
699, Oregon Laws 2007, collected or received by the Department of Education, is
increased by $62,956 for a school improvement fund grant.
SECTION 22. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for all
other federal programs established by section 5 (6), chapter 699, Oregon Laws
2007, for the biennium beginning July 1, 2007, as the maximum limit for payment
of grants-in-aid and purchased services from federal funds received by the
Department of Education from the United States Department of Education and from
other federal agencies other than the United States Department of Agriculture,
is increased by $1,196,170 for a school improvement fund grant.
SECTION 23. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 3, chapter 700, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses by the Department of
Education from fees, moneys or other revenues, including Miscellaneous
Receipts, but excluding lottery funds and federal funds, collected or received
by the Department of Education for the State School Fund, is increased by
$3,005,438 due to increased donations.
SECTION 24. Notwithstanding
any other law limiting expenditures, the limitation on expenditures from the
State School Fund established by section 4 (1), chapter 700, Oregon Laws 2007,
for the fiscal year beginning July 1, 2007, is increased by $3,005,438 due to
increased donations.
SECTION 25. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 3, chapter 726, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from federal funds collected
or received by the Oregon Criminal Justice Commission, is increased by $25,000
for the development of crime statistics and collection of data for individual
tribal communities in Oregon.
SECTION 26. Notwithstanding
any other provision of law, the General Fund appropriation made to the Oregon
Criminal Justice Commission, by section 1, chapter 726, Oregon Laws 2007, for
the biennium beginning July 1, 2007, is decreased by $528,116 for the transfer
of funding for grants to local drug courts to the Department of State Police.
SECTION 27. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures for central services established by section 2 (18), chapter 749,
Oregon Laws 2007, for the biennium beginning July 1, 2007, as the maximum limit
for payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts and federal funds received as reimbursement from the
United States Department of Transportation, but excluding lottery funds and
federal funds not described in section 2, chapter 749, Oregon Laws 2007,
collected or received by the Department of Transportation, is increased by
$798,456 for the purpose of carrying out the provisions of chapter 1, Oregon
Laws 2008 (Enrolled Senate Bill 1080).
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures for driver and
motor vehicle services established by section 2 (11), chapter 749, Oregon Laws
2007, for the biennium beginning July 1, 2007, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including Miscellaneous
Receipts and federal funds received as reimbursement from the United States Department
of Transportation, but excluding lottery funds and federal funds not described
in section 2, chapter 749, Oregon Laws 2007, collected or received by the
Department of Transportation, is increased by $466,410 for the purpose of
carrying out the provisions of chapter 1, Oregon Laws 2008 (Enrolled Senate
Bill 1080).
SECTION 28. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Department of Revenue, for the biennium beginning July 1,
2007, out of the moneys received by the department under ORS 323.005 to 323.482
and 323.500 to 323.645, prior to any other distribution of those moneys, the
amount of $529,000 for paying the expenses of the department for the
administration and enforcement of ORS 323.005 to 323.482 and 323.500 to
323.645, and for reimbursing the Department of Justice and the Department of
State Police for their expenses for administration and enforcement of ORS
323.005 to 323.482 and 323.500 to 323.645.
(2) Notwithstanding any
other provision of law, the General Fund appropriation made to the Department
of Revenue for the purpose of administrative expenses by section 1, chapter
388,
SECTION 29. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
operations established by section 1 (1), chapter 741, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the Oregon
Department of Aviation, is increased by $2,530,383.
SECTION 30. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for
operations established by section 2 (1), chapter 741, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from federal funds collected or received by the Oregon Department of Aviation,
is increased by $42,606 for aviation planning projects.
SECTION 31. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for food
safety established by section 4 (1), chapter 710, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from federal funds, other than those described in section 2, chapter 710,
Oregon Laws 2007, collected or received by the State Department of Agriculture,
is increased by $210,261 to enhance animal trace identification.
SECTION 32. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Department of Land Conservation and Development for the purpose of the
planning program by section 1 (1), chapter 737, Oregon Laws 2007, for the
biennium beginning July 1, 2007, is increased by $426,008 for the 30-year land
use review.
(2) Notwithstanding any
other provision of law, the General Fund appropriation made to the Department
of Land Conservation and Development for the purpose of the planning program by
section 1 (1), chapter 737, Oregon Laws 2007, for the biennium beginning July
1, 2007, is increased by $4,405,534 to implement the claims process under
chapter 424, Oregon Laws 2007 (Ballot Measure 49 (2007)).
SECTION 33. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2, chapter 728, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Department of Justice, is increased
by $1,925,793 to implement the claims process under chapter 424, Oregon Laws
2007 (Ballot Measure 49 (2007)).
SECTION 34. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 3, chapter 728, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from federal funds collected
or received by the Department of Justice, is increased by $1,689,162 for the
federal Violence Against Women Act grant.
SECTION 35. Notwithstanding
any other provision of law, the General Fund appropriation made to the Oregon
Department of Administrative Services for operating expenses of the State
Services Division by section 1 (1), chapter 73, Oregon Laws 2007, for the
biennium beginning July 1, 2007, is decreased by $480,473.
SECTION 36. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of State Police for administrative services, information management
and the Office of the State Fire Marshal by section 1 (4), chapter 439, Oregon
Laws 2007, for the biennium beginning July 1, 2007, is increased by $528,116
for the transfer from the Oregon Criminal Justice Commission of funding for
grants to local drug courts.
SECTION 37. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of State Police, for the biennium beginning July 1, 2007, out
of the General Fund, the amount of $485,223 for costs of additional troopers
for the patrol division.
SECTION 38. (1)
In addition to and not in lieu of any other appropriation, there is appropriated
to the Emergency Board, for the biennium beginning July 1, 2007, out of the
General Fund, the amount of $4,870,055 to be allocated to the Department of
Human Services for costs associated with the

appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 39. Notwithstanding
any other law limiting expenditures, the limitation on expenditures for Seniors
and People with Disabilities established by section 2 (4), chapter 743, Oregon
Laws 2007, for the biennium beginning July 1, 2007, as the maximum limit for
payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, tobacco tax receipts and Medicare receipts and
including federal funds for indirect cost recovery, Social Security
Supplemental Security Income recoveries, the Child Care and Development Fund,
the Women, Infants and Children Program food rebates, the Coordinated School
Health Program, Edward Byrne Memorial State and Local Law Enforcement
Assistance, homeland security and emergency preparedness and response services,
but excluding lottery funds and federal funds not described in section 2,
chapter 743, Oregon Laws 2007, collected or received by the Department of Human
Services, is increased by $400,000 for Oregon Project Independence.
SECTION 40. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 24, chapter 697, Oregon Laws 2007, for the biennium beginning July
1, 2007, as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding lottery funds
and federal funds, collected or received by the Oregon Health Fund Board, is
increased by $440,000 for the purposes of carrying out the provisions of the
Healthy Oregon Act, sections 2 to 13, chapter 697, Oregon Laws 2007.
SECTION 41. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Department of Education for the State School Fund by section 1, chapter
700, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by
$20,000,000.
(2) Notwithstanding any
other law allocating moneys from the Administrative Services Economic
Development Fund, the allocation to the Department of Education for the State
School Fund established by section 8, chapter 745, Oregon Laws 2007, for the
biennium beginning July 1, 2007, is increased by $20,000,000.
(3) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2, chapter 700, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from lottery moneys
allocated from the Administrative Services Economic Development Fund to the
Department of Education for the State School Fund, is increased by $20,000,000.
SECTION 42. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Department of Education for Civics/Chess for Success by section 2 (10),
chapter 699, Oregon Laws 2007, for the biennium beginning July 1, 2007, is
decreased by $50,000.
(2) Notwithstanding any
other provision of law, the General Fund appropriation made to the Department
of Education for operations by section 1 (1), chapter 699, Oregon Laws 2007,
for the biennium beginning July 1, 2007, is increased by $50,000.
SECTION 43. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures established by section 7, chapter 699, Oregon Laws 2007, for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
by the Department of Education from lottery moneys allocated from the
Administrative Services Economic Development Fund to the department for debt
service on the outstanding state education lottery bonds issued during the
1997-1999 and 1999-2001 biennia, is decreased by $1,069,192.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 8, chapter 699, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses by the Department of
Education from lottery moneys allocated from the Oregon Education Fund to the
department for debt service on the outstanding state education lottery bonds
issued during the 1997-1999 and 1999-2001 biennia, is increased by $1,069,192.
SECTION 44. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 1, chapter 215, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, and including federal funds for occupational
safety and health-related activities, manufactured home inspections and senior
health insurance benefit programs, but excluding lottery funds, collected or
received by the Department of Consumer and Business Services, is increased by
$210,019.
SECTION 45. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Housing and Community Services Department, for the biennium
beginning July 1, 2007, out of the General Fund, the amount of $1,000,000 for
the purpose of preserving the state’s existing supply of affordable housing
units. The department shall transfer moneys appropriated under this section
into the Housing Development Account for expenditure to provide loans and
payments under the statutes identified in section 5 (3), chapter 757,

other law limiting expenditures, the limitation on expenditures established by
section 2, chapter 757, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts and federal funds from the United
States Department of Housing and Urban Development for contract services, but
excluding lottery funds and federal funds not described in this subsection,
collected or received by the Housing and Community Services Department, is
increased by $1,000,000.
SECTION 46. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2, chapter 758, Oregon Laws 2007, for the biennium beginning July 1,
2007, as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Judicial Department, is increased
by $10,000,000.
SECTION 47. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Water Resources Department, for the biennium beginning July 1, 2007, out
of the General Fund, the following amounts:
(1) $750,000 for the
purpose of conducting a
(2) $1,750,000 for the
purpose of establishing a grant program and providing grants or payment for
direct services for planning studies performed to evaluate the feasibility of
developing a water conservation, reuse or storage project.
SECTION 48. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Department of Veterans’ Affairs, for the biennium beginning
July 1, 2007, out of the General Fund, the amount of $300,000 to be deposited
in the Veterans’ Small Business Repair Loan Fund established in chapter 18,
Oregon Laws 2008 (Enrolled House Bill 3626).
(2) Notwithstanding any
other law limiting expenditures, the amount of $300,000 is established for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts and the
Veterans’ Small Business Repair Loan Fund, but excluding lottery funds and
federal funds, collected or received by the Department of Veterans’ Affairs,
for the purpose of making loans to veterans under the Veterans’ Small Business
Repair Loan Program.
SECTION 49. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Oregon Military Department for the purpose of emergency management by
section 1 (5), chapter 747, Oregon Laws 2007, for the biennium beginning July
1, 2007, is increased by $500,000 for deposit in the Oregon Local Disaster
Assistance Loan Account established in chapter 18, Oregon Laws 2008
(Enrolled House Bill 3626).
(2) Notwithstanding any
other law limiting expenditures, the amount of $500,000 is established for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, moneys
received from federal grants for disaster response efforts and the Oregon Local
Disaster Assistance Loan Account, but excluding lottery funds and federal funds
not described in this subsection, collected or received by the Oregon Military
Department for the purpose of making loans to local governments and school
districts.
SECTION 50. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $1,000,000 to be allocated to the
Judicial Department, the Department of Corrections or the Public Defense
Services Commission for costs of carrying out the provisions of
chapter 14, Oregon Laws 2008 (Enrolled Senate Bill 1087).
(2) If any of the moneys
appropriated under subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 51. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Human Services, for the biennium beginning July 1, 2007,
out of the General Fund, the amounts of:
(1) $500,000 for
community health care delivery grants;
(2) $275,000 for the
Children’s Wraparound Initiative; and
(3) $150,000 for
community mental health assessment and evaluation.
SECTION 52. This
2008 Act being necessary for the immediate preservation of the public peace,
health and safety, an emergency is declared to exist, and this 2008 Act takes
effect on its passage.
