Chapter 22 Oregon Laws 2009
AN ACT
SB 5552
Relating to state financial administration; creating new provisions; repealing section 37, chapter 16, Oregon Laws 2008; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. Notwithstanding any other provision of law, the authorized appropriations and expenditure limitations for the biennium beginning July 1, 2007, for the following agencies and programs are changed by the amounts specified:

SECTION 2. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services for distribution to counties for economic development activities established by section 24, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is reduced by $6,399,691.
SECTION 3. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Sports Lottery Account established by section 23, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is increased by $10,017.
SECTION 4. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Problem Gambling Treatment Fund established by section 11, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $1,189,984.
SECTION 5. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Higher Education established by section 21, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $532,268.
SECTION 6. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Housing and Community Services Department established by section 14, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $330,909.
SECTION 7. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department established by section 3 (10), chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $2,788,960.
SECTION 8. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Transportation established by section 9, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $422,057.
SECTION 9. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 18, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $167,538.
SECTION 10. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Higher Education established by section 27, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $1,218,858.
SECTION 11. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Housing and Community Services Department established by section 15, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $3,576.
SECTION 12. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department established by section 6, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $225,742.
SECTION 13. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 19a, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $62,589.
SECTION 14. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Education established by section 8, chapter 745, Oregon Laws 2007, and section 41 (2), chapter 16, Oregon Laws 2008, for the biennium beginning July 1, 2007, is increased by $13,269,979.
SECTION 15. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the office of the Governor established by section 22, chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $112,000.
SECTION 16. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department for department operations established by section 3 (1), chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $465,000.
SECTION 17. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department for the Oregon Community Development Fund established by section 3 (3), chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $2,883,808.
SECTION 18. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department for the Strategic Reserve for Workforce established by section 3 (4), chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $341,244.
SECTION 19. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department for targeted service providers established by section 3 (5), chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $100,000.
SECTION 20. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Economic and Community Development Department for the Oregon Film and Video Office established by section 3 (9), chapter 745, Oregon Laws 2007, for the biennium beginning July 1, 2007, is decreased by $64,085.
SECTION 21. Notwithstanding any other law allocating moneys from the Watershed Improvement Operating Fund, the allocation from the Oregon Watershed Enhancement Board to the Department of Environmental Quality for activities and projects to implement section 4 (10), Article XV of the Oregon Constitution, established by section 4, chapter 732, Oregon Laws 2007, for the biennium beginning July 1, 2007, is increased by $427,630.
SECTION 22. There is appropriated to the School Day Restoration Fund, for the biennium beginning July 1, 2007, out of the General Fund, the amount of $51,000,000 for the purpose of carrying out the provisions of sections 19 to 21, chapter 21, Oregon Laws 2009 (Enrolled Senate Bill 581).
SECTION 23. Notwithstanding any other law limiting expenditures, the amount of $16,750 is established for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from federal funds collected or received by the office of the Governor.
SECTION 24. Notwithstanding any other law limiting expenditures, the amount of $55,639,902 is established for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from federal funds collected or received by the Department of Higher Education.
SECTION 25. Notwithstanding any other law limiting expenditures, the amount of $115,360,098 is established for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from federal funds collected or received by the Department of Education for the State School Fund.
SECTION 26. Notwithstanding any other provision of law, the General Fund appropriation made to the Water Resources Department by section 47 (2), chapter 16, Oregon Laws 2008, for the biennium beginning July 1, 2007, is decreased by $694,165.
SECTION 27. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Veterans’ Affairs by section 48 (1), chapter 16, Oregon Laws 2008, for the biennium beginning July 1, 2007, is decreased by $185,941.
SECTION 28. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 1, chapter 19, Oregon Laws 2007, for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, and reimbursements from federal services agreements, but excluding lottery funds and federal funds not described in this section, collected or received by the Oregon State Board of Nursing, is increased by $110,000.
SECTION 29. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 1, chapter 37, Oregon Laws 2007, for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, and reimbursements from federal services agreements, but excluding lottery funds and federal funds not described in this section, collected or received by the Oregon Board of Dentistry, is increased by $50,000.
SECTION 30. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 1, chapter 38, Oregon Laws 2007, for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, and reimbursements from federal services agreements, but excluding lottery funds and federal funds not described in this section, collected or received by the State Board of Psychologist Examiners, is increased by $98,000.
SECTION 31. Section 37, chapter 16, Oregon Laws 2008, is repealed.
SECTION 32. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect on its passage.
