Chapter 185 Oregon Laws 2009

Relating to performance security of lottery contractors; creating new provisions; and amending ORS 461.430.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 461.430 is amended to read:
461.430. (1) [Each] A lottery contractor shall perform its contract consistent with the laws of this state, federal law, and laws of the state or states in which [such lottery contractor is performing or producing, in whole or in parts, any of the goods or services contracted for hereunder] the lottery contractor, in whole or in part, performs services or produces goods required by the contract.
[(2) Each lottery contractor for the printing of tickets used in any lottery game, for providing goods or services involving the receiving or recording of number selections in any lottery game or for providing goods or services involving the determination of winners in any lottery game shall, at the time of executing the contract with the commission, post a performance bond with the commission, using a surety acceptable to the commission, in an amount acceptable to the commission.]
(2) At the time specified in the contract, a lottery contractor shall post performance security with the Oregon State Lottery Commission in a form and an amount acceptable to the commission and issued by a surety, financial institution, insurer, escrow agent or other person acceptable to the commission if the lottery contractor:
(a) Prints tickets used in a lottery game;
(b) Provides goods or performs services involving the receipt or recording of number selections in a lottery game; or
(c) Provides goods or performs services involving the determination of winners in a lottery game.
SECTION 2. The amendments to ORS 461.430 by section 1 of this 2009 Act apply to contracts entered into or renewed on or after the effective date of this 2009 Act.
