AN ACT

 

SB 120

 

Relating to first aid cards; creating new provisions; amending ORS 342.169; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. ORS 342.169 is amended to read:

          342.169. (1) The State Board of Education shall establish by rule the ratio of the number of pupils to the number of staff members who must hold current, recognized first aid cards in each school.

          (2) In order to attain or maintain the ratio set under subsection (1) of this section, the district may require any staff member as a condition of employment to hold a current, recognized first aid card. The staff member shall have 90 days from the date on which the district imposes the requirement to obtain the first aid card.

          (3) The district [shall] may waive the requirement of subsection (2) of this section for any staff member who [has had the requirement waived by the Teacher Standards and Practices Commission and may waive the requirement for other staff who are] is unable by reason of disability to obtain a recognized first aid [cards] card.

          (4) The district shall certify annually to the Department of Education that it complies with the ratio requirement set under subsection (1) of this section.

 

          SECTION 2. Notwithstanding any other provision of law, ORS 342.169 is not considered to have been added to or made a part of ORS 342.120 to 342.430 for the purpose of statutory compilation or for the application of definitions, penalties or administrative provisions applicable to statute sections in that series.

 

          SECTION 3. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect on its passage.
