AN ACT
SB 166
Relating to public facility planning; creating new provisions; amending ORS 426.010; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) Notwithstanding ORS 421.611 to 421.630 or any actions taken under ORS 421.611 to 421.630, the Department of Corrections may lease all or part of the real property and any improvements to the real property known as the Milliron Road Site south of Junction City, Lane County, to the Department of Human Services for a period of years agreed upon by the Department of Corrections and the Department of Human Services.
(2) The Department of Human Services may build, own and operate, on the real property leased from the Department of Corrections under subsection (1) of this section, a hospital to provide diagnosis and evaluation, medical care, detoxification, social services, rehabilitation or other services for individuals committed to the Department of Human Services under ORS 426.130 and individuals committed to a state hospital under ORS 161.327 or 161.370.
(3) The Department of Corrections and the Department of Human Services are authorized to negotiate and enter into a written agreement transferring ownership of the hospital described in subsection (2) of this section from the Department of Human Services to the Department of Corrections, under terms and conditions acceptable to the agencies.
SECTION 2. ORS 426.010 is amended to read:
426.010. Except as otherwise ordered by the Department of Human Services pursuant to ORS 179.325, the Oregon State Hospital [in Salem, Marion County,] campuses in Salem, Marion County, and in Junction City, Lane County, and the Blue Mountain Recovery Center in Pendleton, Umatilla County, shall be used as state hospitals for the care and treatment of mentally ill persons who are assigned to the care of such institutions by the department or who have previously been committed to such institutions.
SECTION 3. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect on its passage.
