Chapter 332 Oregon Laws 2009
AN ACT

Relating to emergency response times; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. Section 2 of this 2009 Act is added to and made a part of ORS 401.710 to 401.816.
SECTION 2. A governing body may not enforce contractual provisions that have the effect of punishing or penalizing a public or private safety agency for failure to meet mandatory response times during a declared state of emergency in which the public or private safety agency has allowed agency resources to respond and provide emergency services outside the normal service area of the agency.
SECTION 3. Section 2 of this 2009 Act applies to a contract entered into, renewed or extended on or after the effective date of this 2009 Act.
SECTION 4. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect on its passage.
