Chapter 517 Oregon Laws 2009

 

AN ACT

Relating to online sexual corruption of a child; creating new provisions; and amending ORS 163.431.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. ORS 163.431 is amended to read:

          163.431. As used in ORS [163.432] 163.431 to 163.434:

          (1) “Child” means a person who the defendant reasonably believes to be under 16 years of age.

          (2) “Online communication” means communication that occurs via telephone text messaging, electronic mail, personal or instant messaging, chat rooms, bulletin boards or any other [method of communicating over the Internet] transmission of information by wire, radio, optical cable, cellular system, electromagnetic system or other similar means.

          (3) “Sexual contact” has the meaning given that term in ORS 163.305.

          (4) “Sexually explicit conduct” has the meaning given that term in ORS 163.665.

          (5) “Solicit” means to invite, request, seduce, lure, entice, persuade, prevail upon, coax, coerce or attempt to do so.

 

          SECTION 2. ORS 163.431 to 163.434 are added to and made a part of ORS chapter 163.

 

          SECTION 3. The amendments to ORS 163.431 by section 1 of this 2009 Act apply to communications that occur on or after the effective date of this 2009 Act.
