Chapter 668 Oregon Laws 2009

 

AN ACT

 

HB 5014

 

Relating to financial administration of the State Department of Fish and Wildlife; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There are appropriated to the State Department of Fish and Wildlife, for the biennium beginning July 1, 2009, out of the General Fund, the following amounts for the following purposes:

 

      (1)    Fish Division:

      (a)    Fish propagation.............................     $  5,338,899

      (b)   Fish natural production.................     $  3,478,651

      (c)    Fish marine resources....................     $  1,103,555

      (2)    Wildlife Division:

      (a)    Wildlife game..................................     $     198,779

      (b)   Wildlife habitat...............................     $     934,718

      (c)    Wildlife diversity.............................     $ 1,206,472

      (3)    Administrative Services

              Division............................................     $  1,899,101

      (4)    Debt service.....................................     $     355,543

      (5)    Capital improvement......................     $     157,553

 

          SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and including federal funds for contract services, but excluding lottery funds and federal funds not described in this section, collected or received by the State Department of Fish and Wildlife, for the following purposes:

 

      (1)    Fish Division:

      (a)    Fish propagation.............................     $ 11,957,340

      (b)   Fish natural production.................     $ 25,141,630

      (c)    Fish marine resources....................     $ 10,523,810

      (d)   Fish interjurisdictional

              fisheries............................................     $ 10,342,118

      (2)    Wildlife Division:

      (a)    Wildlife game..................................     $ 23,539,201

      (b)   Wildlife habitat...............................     $ 10,894,899

      (c)    Wildlife diversity.............................     $     395,779

      (3)    Administrative Services

              Division............................................     $ 37,171,226

      (4)    Capital improvement......................     $  6,527,110

      (5)    Department of State Police

              enforcement contract.....................     $ 18,631,254

 

          SECTION 3. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limit for payment of expenses from lottery moneys allocated from the Parks and Natural Resources Fund to the State Department of Fish and Wildlife, for activities and projects to implement section 4 (10), Article XV of the Oregon Constitution, for the following purposes:

 

      (1)    Fish Division,

              fish natural production..................     $  5,416,256

      (2)    Wildlife Division,

              wildlife habitat................................     $     999,970

 

          SECTION 4. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from federal funds other than those described in section 2 of this 2009 Act collected or received by the State Department of Fish and Wildlife, for the following purposes:

 

      (1)    Fish Division:

      (a)    Fish propagation.............................     $ 31,534,225

      (b)   Fish natural production.................     $ 29,892,159

      (c)    Fish marine resources....................     $  4,967,082

      (d)   Fish interjurisdictional

              fisheries............................................     $  9,110,209

      (2)    Wildlife Division:

      (a)    Wildlife game..................................     $  3,312,226

      (b)   Wildlife habitat...............................     $  9,366,446

      (c)    Wildlife diversity.............................     $  2,720,233

      (3)    Administrative Services

              Division............................................     $  1,932,270

      (4)    Capital improvement......................     $     150,193

 

          SECTION 5. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect July 1, 2009.
