Chapter 684 Oregon Laws 2009

AN ACT

HB 5040

Relating to financial administration of the Public Defense Services Commission; appropriating money; limiting expenditures; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

SECTION 1. There are appropriated to the Public Defense Services Commission, for the biennium beginning July 1, 2009, out of the General Fund, the following amounts for the following purposes:

(1)    Appellate Division.....................       $    10,690,165

      (2)    Public Defense Services

              Account.....................................       $  198,319,908

      (3)    Contract and Business

              Services Division.......................       $      3,187,312

SECTION 2. Notwithstanding any other law limiting expenditures, the amount of $512,049 is established for the biennium beginning July 1, 2009, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Public Defense Services Commission, for the Contract and Business Services Division.

SECTION 3. (1) Notwithstanding any other provision of law, the General Fund appropriation made to the Public Defense Services Commission by section 1 (1), chapter 596, Oregon Laws 2007, for the biennium ending June 30, 2009, for the purpose of legal services, as modified by Emergency Board action, is decreased by $26,500.

          (2) Notwithstanding any other provision of law, the General Fund appropriation made to the Public Defense Services Commission by section 1 (3), chapter 596, Oregon Laws 2007, for the biennium ending June 30, 2009, for the purpose of contract and business services, as modified by Emergency Board action, is decreased by $24,900.

SECTION 4. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect on its passage.
