Chapter 739 Oregon Laws 2009

AN ACT

SB 5548

Relating to financial administration of the Department of Transportation; limiting expenditures; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

SECTION 1. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and federal funds received as reimbursement from the United States Department of Transportation, but excluding lottery funds and federal funds not described in this section, collected or received by the Department of Transportation, for the following purposes:

(1)    Capital improvement...................   $        3,259,788

      (2)    Maintenance and emergency

      (3)    Preservation program.................   $    390,010,301

      (4)    Bridge program...........................   $    698,771,709

      (5)    Highway safety program............   $      72,042,873

      (7)    Modernization program..............   $    349,139,964

      (8)    Special programs.........................   $    217,001,948

      (9)    Local government program........   $    390,986,455

      (10)  Driver and motor vehicle

SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from federal funds other than those described in section 1 of this 2009 Act, collected or received by the Department of Transportation, for the following purposes:

(1)    Motor carrier transportation......   $        5,561,876

      (2)    Transportation program

              development.................................   $           210,710

      (3)    Public transit................................   $      47,849,734

      (4)    Rail................................................   $      16,306,903

      (5)    Transportation safety..................   $      15,116,662

      (6)    Central services............................   $             30,797

      (7)    Driver and motor

              vehicle services.............................   $        2,545,006

SECTION 3. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the Department of Transportation for debt service for the following purposes:

(1)    Westside Light Rail.....................   $        2,863,158

      (2)    Short Line Infrastructure

      (3)    Industrial Rail Spur

              Infrastructure Assistance............   $        1,418,156

      (4)    South Metro Commuter Rail......   $        3,244,376

SECTION 4. For the biennium beginning July 1, 2009, expenditures by the Department of Transportation from the Oregon Transportation Infrastructure Fund established under ORS 367.015 for debt service and for internally reimbursed expenditures are not limited.

SECTION 5. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect July 1, 2009.
