Chapter 860 Oregon Laws 2009

 

AN ACT

 

HB 5005

 

Relating to financial administration of the Department of Corrections; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There are appropriated to the Department of Corrections, for the biennium beginning July 1, 2009, out of the General Fund, the following amounts for the following purposes:

 

      (1)    Operations and health

              services...........................................   $  854,571,349

      (2)    Administration, public services,

              general services and

              human resources...........................   $  132,971,985

      (3)    Transitional services.....................   $    78,896,953

      (4)    Community corrections................   $  104,833,832

      (5)    Debt service...................................   $  135,042,223

      (6)    Capital improvements...................   $      6,241,965

 

          SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Corrections, for the following purposes:

 

      (1)    Operations and health services....   $    16,394,628

      (2)    Administration, public services,

              and general services......................   $    12,851,602

      (3)    Transitional services.....................   $      8,268,469

      (4)    Community corrections................   $      1,919,722

      (5)    Debt service...................................   $      2,910,092

 

          SECTION 3. Notwithstanding any other law limiting expenditures, the amount of $108,541,761 is established for the biennium beginning July 1, 2009, as the maximum limit for payment of expenses from federal funds collected or received by the Department of Corrections for operations.

 

          SECTION 4. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Corrections for administration, public services, general services and human resources established by section 1 (2), chapter 594, Oregon Laws 2007, for the biennium ending June 30, 2009, is reduced by $1,422,689.

 

          SECTION 5. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Corrections for community corrections established by section 1 (4), chapter 594, Oregon Laws 2007, for the biennium ending June 30, 2009, is increased by $1,500,000.

 

          SECTION 6. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Corrections for debt service established by section 1 (5), chapter 594, Oregon Laws 2007, for the biennium ending June 30, 2009, is reduced by $77,311.

 

          SECTION 7. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect on its passage.
