Chapter 862 Oregon Laws 2009

 

AN ACT

 

HB 5037

 

Relating to financial administration of the Department of State Police; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There are appropriated to the Department of State Police, for the biennium beginning July 1, 2009, out of the General Fund, the following amounts for the following purposes:

 

      (1)    Patrol services, criminal

              investigations and gaming

              enforcement...................................   $  141,557,854

      (2)    Fish and wildlife enforcement......   $      1,886,720

      (3)    Forensic services and State

              Medical Examiner.........................   $    32,925,103

      (4)    Administrative services,

              information management and

              Office of the State Fire

              Marshal..........................................   $    42,465,415

      (5)    Oregon Wireless

              Interoperability Network.............   $      3,540,076

      (6)    Debt Service...................................   $    14,420,077

 

          SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of State Police, for the following purposes:

 

      (1)    Patrol services, criminal

              investigations and gaming

              enforcement...................................   $    29,603,130

      (2)    Fish and wildlife enforcement......   $    21,362,747

      (3)    Forensic services and

              State Medical Examiner...............   $         483,647

      (4)    Administrative services,

              information management and

              Office of the State Fire

              Marshal..........................................   $    41,771,024

      (5)    Oregon Wireless

              Interoperability Network.............   $      5,619,824

 

          SECTION 3. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2009, as the maximum limits for payment of expenses from federal funds collected or received by the Department of State Police for the following purposes:

 

      (1)    Patrol services, criminal

              investigations and gaming

              enforcement...................................   $      1,176,422

      (2)    Fish and wildlife enforcement......   $      2,245,449

      (3)    Forensic services and

              State Medical Examiner...............   $      1,910,571

      (4)    Administrative services,

              information management and

              Office of the State Fire

              Marshal..........................................   $      1,264,280

      (5)    Oregon Wireless

              Interoperability Network.............   $         751,825

 

          SECTION 4. Notwithstanding any other law limiting expenditures, and notwithstanding ORS 541.377 (7), the amount of $7,442,864 is established for the biennium beginning July 1, 2009, as the maximum limit for payment of expenses by the Department of State Police for fish and wildlife enforcement activities from moneys or other revenues allocated to the Parks and Natural Resources Fund and from lottery funds made available to the Parks and Natural Resources Fund under section 4 (10), Article XV of the Oregon Constitution.

 

          SECTION 5. This 2009 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2009 Act takes effect July 1, 2009.
