AN ACT
Relating to bonds for schools; amending ORS 332.176; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 332.176 is amended to read:
332.176. (1) As used in this section, 'large construction
project' means a { + construction + } project for which a school
district must submit the question of bonded indebtedness to the
electors of the school district and the total bonded indebtedness
for the project is greater than $1 million.
(2) Prior to receiving approval from the electors of the school
district for bonded indebtedness for a large construction
project, a school district shall:
(a) Evaluate the need for safety improvements within one mile
of an elementary school or 1.5 miles of a secondary school where
the large construction project is to be completed. The safety
improvements should provide safer alternative routes to schools
and may include improvements for pedestrians, bicycles and motor
vehicles.
(b) Evaluate the potential for joint funding of safety
improvements with other public and private entities.
(c) Consider including the funding of safety improvements
within the funding of the large construction project. The
consideration of and the school district board's decision on the
funding for safety improvements as part of a large construction
project shall be part of the public record relating to the
project.
{ + (3) After receiving approval from electors for bonded
indebtedness for a large construction project, a school district
may select a site for the large construction project that is
different from the site proposed prior to the election if the
school district makes an evaluation for safety improvements for
the new site as described in subsection (2) of this section
before issuing any bonds for the project. + }
SECTION 2. { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
