SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Increases fees on specified angling and hunting licenses.
Requires certain amount from sale of sportsperson's license to
be credited to State Wildlife Fund. Increases other amounts
credited from sale of sportsperson's license to specified
subaccounts.
Extends and increases surcharges on certain hunting and angling
licenses. Extends surcharges on Ocean Troll Salmon Fishery
permits and Columbia River Gillnet Fishery permits. Extends
poundage fees for certain fish species.
Takes effect December 30, 2009.
A BILL FOR AN ACT
Relating to State Department of Fish and Wildlife; amending ORS
497.132 and sections 4, 6 and 8, chapter 512, Oregon Laws 1989;
and prescribing an effective date.
Be It Enacted by the People of the State of Oregon:
SECTION 1. Section 4, chapter 512, Oregon Laws 1989, as amended
by section 1, chapter 184, Oregon Laws 1991, section 3, chapter
619, Oregon Laws 1993, section 9, chapter 8, Oregon Laws 1997,
section 11, chapter 1006, Oregon Laws 1999, and section 1,
chapter 643, Oregon Laws 2003, is amended to read:
{ + Sec. 4. + } In addition to the fees otherwise prescribed
by law, the issuer of each of the following licenses shall charge
and collect each time the license is issued, during the period
beginning January 1, 1998, and ending December 31, { - 2009 - }
{ + 2019 + }, the following surcharges:
(1) Resident combination license issued under ORS 497.132,
{ - $2 - } { + $4 + }.
(2) Resident annual angling license issued under ORS 497.121
(1)(a), { - $2 - } { + $3 + }.
(3) Resident juvenile angling license issued under ORS 497.121
(1)(e), { - $1 - } { + $2 + }.
(4) Angling license to angle for one day issued under ORS
497.121 (1)(d), { - $1 - } { + $2 + }.
(5) Nonresident annual angling license issued under ORS 497.121
(1)(b), { - $5 - } { + $6 + }.
(6) Nonresident angling license to angle for seven consecutive
days issued under ORS 497.121 (1)(c), { - $2.50 - }
{ + $3.50 + }.
SECTION 2. ORS 497.132 is amended to read:
497.132. (1) In lieu of issuing to resident persons separate
licenses for angling and hunting, the State Fish and Wildlife
Commission is authorized to issue resident annual combination
angling and hunting licenses, and charge therefor a fee of
{ - $38 - } { + $47 + }.
(2)(a) In lieu of issuing to resident persons separate licenses
and tags for various hunting and angling activities, the
commission is authorized to issue resident annual sportsperson's
licenses and shall charge therefor a fee of { - $125 - } { +
$155 + }. The purchaser of each such license is authorized to
engage in those hunting and angling activities for which the
following licenses and tags are required:
(A) Combination license;
(B) Black bear tag;
(C) Cougar tag;
(D) General season elk tag;
(E) General season deer tag;
(F) Upland bird stamp;
(G) Oregon migratory waterfowl stamp;
(H) Turkey tag; and
(I) Annual tag to angle for salmon, steelhead trout, sturgeon
and halibut.
(b) The holder of each sportsperson's license who wishes to
engage in hunting or angling activities for which permits are
required that are limited by quota must participate in the
process for allocation of the permits in the same manner as all
other permit applicants. However, if the holder of a
sportsperson's license is unsuccessful in obtaining a permit
limited by quota for a particular activity, the holder will be
issued a tag valid for any general season for that species.
(c) Notwithstanding any other provision of the wildlife laws,
of the moneys received from the sale of sportsperson's licenses:
(A) { - Two - } { + Four + } dollars from each such license
shall be credited to the subaccount referred to in ORS 496.242.
(B) { - Two - } { + Four + } dollars from each such license
shall be credited to the subaccount referred to in ORS 496.283.
(C) { - Twenty-five - } { + Seventy-five + } cents from
each such license shall be credited to the Fish Screening
Subaccount established under ORS 496.303.
{ + (D) Twenty-five cents from each such license shall be
credited to the State Wildlife Fund established under ORS
496.300. + }
SECTION 3. Section 6, chapter 512, Oregon Laws 1989, as amended
by section 2, chapter 184, Oregon Laws 1991, section 10, chapter
8, Oregon Laws 1997, and section 2, chapter 643, Oregon Laws
2003, is amended to read:
{ + Sec. 6. + } In addition to the fees otherwise prescribed
by law, the issuer of each of the following permits shall charge
and collect each time the permit is issued, during the period
beginning January 1, 1998, and ending December 31, { - 2009 - }
{ + 2019 + }, the following surcharges:
(1) Ocean Troll Salmon Fishery permit issued under ORS 508.816,
$65.
(2) Columbia River Gillnet Fishery permit issued under ORS
508.790, $74.
SECTION 4. Section 8, chapter 512, Oregon Laws 1989, as amended
by section 3, chapter 184, Oregon Laws 1991, section 11, chapter
8, Oregon Laws 1997, and section 3, chapter 643, Oregon Laws
2003, is amended to read:
{ + Sec. 8. + } In addition to the ad valorem fee prescribed
by law, during the period beginning January 1, 1998, and ending
December 31, { - 2009 - } { + 2019 + }, there shall be paid
for each fish species referred to in ORS 508.505 (1)(a), an
additional fee of five cents per pound. The ad valorem fee
referred to in this section is subject to ORS 508.505 to 508.540.
SECTION 5. { + This 2009 Act takes effect on December 30,
2009. + }
