Authorizes Oregon Transportation Commission to adopt rules
governing { - activities in state highway rights of way, - }

overlooks.
Punishes violation of rules by maximum fine of $360.
A BILL FOR AN ACT
Relating to regulation of activities in the state highway rights
of way.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Sections 2 and 3 of this 2009 Act are added to
and made a part of ORS chapter 366. + }
SECTION 2. { + The Oregon Transportation Commission may adopt
rules governing health and safety in roadside rest areas and
scenic overlooks under the jurisdiction of the Department of
Transportation. + }
SECTION 3. { + Subject to ORS 153.022, a person who violates
any rule adopted by the Oregon Transportation Commission
governing health and safety in roadside rest areas or scenic
overlooks commits a Class B violation. + }
