                             SUMMARY

  Increases death certificate fees.
  Applies to death certificates issued on or after   { - January
1, 2010 - }  { +  effective date of Act + }.

                        A BILL FOR AN ACT
Relating to certificates of death; creating new provisions;
  amending ORS 432.312; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 432.312 is amended to read:
  432.312. (1) The Department of Human Services shall impose and
collect a filing fee of   { - $7 - }  { +  $20 + } for each
certificate of death. Of the fee,   { - $2 - }  { +  $6 + } shall
be deposited to the credit of the Public Health Account and used
to carry out the purposes of ORS 97.170 (5) and   { - $5 - }
 { +  $14 + } shall be deposited to the credit of the State
Mortuary and Cemetery Board Account and used in the same manner
as funds credited to the account under ORS 692.375.
  (2) The expenditures under ORS 97.170 (5) and 692.375 shall not
exceed the funds collected under subsection (1) of this section,
and in no event shall expenditure on the administration of the
funds exceed five percent of the moneys collected.
  SECTION 2.  { + The amendments to ORS 432.312 by section 1 of
this 2009 Act apply to death certificates issued on or after the
effective date of this 2009 Act. + }
  SECTION 3.  { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
