                             SUMMARY

  Allows Oregon Liquor Control Commission to deny issuance of
additional retail license to person based on retail licensee
record regarding sales of alcoholic beverages to minors.
 
                        A BILL FOR AN ACT
Relating to the responsible vendor program; creating new
  provisions; and amending ORS 471.344.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 471.344 is amended to read:
  471.344. (1) The Oregon Liquor Control Commission shall by rule
establish a responsible vendor program. The program shall include
a list of positive measures that a retail licensee, as defined in
ORS 471.392, must take to avoid sales of alcoholic beverages to
minors. Any retail licensee may participate in the program.
  (2) If a retail licensee, as defined in ORS 471.392,
participates in the responsible vendor program established under
this section, and the licensee takes all measures specified by
the program as necessary to prevent sales of alcoholic beverages
to minors, the commission   { - shall - }  { +  may + } not
cancel the license of the licensee, or deny   { - issuance - }
 { +  renewal + } of a license to the person that holds the
retail license, based on sales of alcoholic beverages to minors
by employees of the licensee. { +  However, the commission may
deny an application for the issuance of an additional retail
license to the person based upon the retail licensee, during the
two years preceding the application date, having a poor record
for compliance with the alcoholic liquor laws relating to sales
of alcoholic beverages to minors. + }
  SECTION 2.  { + The amendments to ORS 471.344 by section 1 of
this 2009 Act apply to retail license applications pending before
the Oregon Liquor Control Commission on or after the effective
date of this 2009 Act. + }
