                             SUMMARY

  Requires hospital emergency department to provide safe and
effective care to individuals with mental illness and care that
uses evidence-based practices and best practices from fields of
mental health, trauma and emergency medical services. Requires
Department of Human Services to adopt rules.
 
                        A BILL FOR AN ACT
Relating to treatment of individuals with mental illness in
  hospital emergency departments.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2009 Act is added to and made
a part of ORS 441.015 to 441.063. + }
  SECTION 2.  { + (1) A hospital licensed under ORS 441.015 to
441.063 shall ensure that an emergency department within the
hospital uses evidence-based practices and best practices from
the fields of mental health, trauma and emergency medical
services in the treatment of individuals with mental illness.
  (2) The Department of Human Services shall adopt rules
establishing standards for subsection (1) of this section that
are designed to protect the dignity of individuals with mental
illness and to provide individuals with mental illness with safe
and effective care in hospital emergency departments. + }
