  Requires Director of Department of Environmental Quality to
establish automatic tank gauge grant program.
  Appropriates moneys from General Fund to Department of
Environmental Quality for purpose of awarding grants under
automatic tank gauge grant program.
 
                        A BILL FOR AN ACT
Relating to automatic tank gauge grant program; and appropriating
  money.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. { +  (1) The Director of the Department of
Environmental Quality shall establish an automatic tank gauge
grant program to fund the replacement of automatic tank gauges,
or parts of automatic tank gauges, on underground storage tanks,
as defined in ORS 466.706, when a gauge or part of a gauge must
be replaced to meet the requirement of ORS 646.913 that gasoline
contain 10 percent ethanol by volume.
  (2) The director shall adopt rules establishing grant
application procedures and criteria for grant approval.
  (3) If the director approves a grant under this section, the
director shall set the amount of the grant awarded to the grant
recipient.
  (4) The director shall monitor grant recipients for compliance
with grant criteria and procedures established by the
director. + }
  SECTION 2.  { + There is appropriated to the Department of
Environmental Quality, for the biennium beginning July 1, 2009,
out of the General Fund, the amount of $___ for the purpose of
carrying out the provisions of section 1 of this 2009 Act. + }
