                         HOUSE BILL 2375

  On page 1 of the printed bill, delete lines 5 through 8 and
insert:
  '  { +  SECTION 1. + }  { + (1) Notwithstanding ORS 215.130 (5)
or (6), the use of a building, structure or land approved under
ORS 215.213 (2)(w) or 215.283 (2)(y), as those provisions were in
effect from June 6, 2003, through the effective date of this 2009
Act:
  ' (a) May not be altered except to comply with a lawful
requirement for alteration in the use to satisfy a public health
or safety requirement enacted on or after July 1, 2009.
  ' (b) May not be restored or replaced because of fire, other
casualty or natural disaster.
  ' (c) Must be discontinued on the date on which:
  ' (A) A change of ownership of any kind occurs, including a
change by sale, transfer, conveyance or reorganization of a legal
entity that owns the building, structure or land;
  ' (B) A new or additional mortgage, lien or other encumbrance
is secured by the building, structure or land;
  ' (C) A permit issued by a public body, as defined in ORS
174.109, that is necessary to the use of the building, structure
or land expires; or
  ' (D) The use of the building, structure or land ceases to
comply with the public health and safety requirements of a public
body.
  ' (2) A permit issued by a public body for the use of a
building, structure or land approved under ORS 215.213 (2)(w) or
215.283 (2)(y), as those provisions were in effect from June 6,
2003, through the effective date of this 2009 Act:
  ' (a) Applies only to the current owner's use of the building,
structure or land.
  ' (b) May not be amended, extended or renewed. + } ' .
