SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
Establishes Aging and Disability Resource Center program in
Department of Human Services. Specifies components of program.
Appropriates moneys from General Fund to department to plan and
implement program.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to services to vulnerable individuals; creating new
provisions; amending ORS 410.422; appropriating money; and
declaring an emergency.
Whereas Oregon's population of people 65 years of age or older
will double by the year 2030; and
Whereas Oregon is a pioneer in developing community-based care
options for seniors and people with disabilities; and
Whereas Oregon will be severely challenged financially to
adequately support the long term care, medical and transportation
needs of its rapidly growing population of seniors and people
with disabilities; and
Whereas Senate Bill 1061, enacted by the 2008 Legislative
Assembly, directed the Department of Human Services to develop a
comprehensive plan for the future of long term care for seniors
and people with disabilities; now, therefore,
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Aging and Disability Resource Center
program is established in the Department of Human Services. The
program shall provide comprehensive information, education and
assistance regarding long term support and services to seniors,
people with physical disabilities, their volunteer caregivers and
individuals approaching the need for late life care. The program
shall be available statewide and shall be aimed at individuals
who are at risk of becoming impoverished and dependent on public
assistance. The program consists of three components:
(a) A central information center to provide information and
referral on a broad array of resources and services including:
(A) Prevention and early intervention activities;
(B) Benefits counseling on private and public programs; and
(C) Public education for seniors and people with physical
disabilities to stay healthy, safe and independent in their own
homes.
(b) A local assistance center in each planning and service area
of Oregon's area agencies on aging. The centers shall provide:
(A) Long term care options counseling;
(B) Access to state-funded long term care and financial
assistance programs;
(C) Short term case management;
(D) Access to emergency and adult protective services; and
(E) Public education.
(c) Direct services including:
(A) In-home services;
(B) Caregiver support;
(C) Healthy living options counseling, resources and services;
(D) Financial planning resources;
(E) Volunteer services; and
(F) Chronic disease management.
(2) The department shall appoint a rules advisory committee
under ORS 183.333 for the adoption of rules regarding the
program. The committee shall include consumers, stakeholders,
advocates for seniors and people with physical disabilities and
community partners. The department shall consult and collaborate
with the committee in the planning and development of the
program. + }
SECTION 2. { + The Department of Human Services shall report
on the progress in planning and implementing the Aging and
Disability Resource Center program to the appropriate interim
committees of the Legislative Assembly. + }
SECTION 3. ORS 410.422 is amended to read:
410.422. (1) The Oregon Project Independence Fund is
established in the State Treasury, separate and distinct from the
General Fund. Interest earned by the Oregon Project Independence
Fund shall be credited to the Oregon Project Independence Fund.
Moneys in the Oregon Project Independence Fund at the end of a
biennium are retained in the Oregon Project Independence Fund and
do not revert to the General Fund.
(2) The Oregon Project Independence Fund consists of moneys
appropriated to the fund by the Legislative Assembly, interest
earned by the fund, moneys contributed to the fund by donors and
moneys transferred to the fund under ORS 311.701.
(3) Moneys in the Oregon Project Independence Fund are
continuously appropriated to the Department of Human Services for
the purpose of funding Oregon Project Independence as provided in
ORS 410.410 to 410.480 { + and the Aging and Disability Resource
Center program established in section 1 of this 2009 Act + }.
SECTION 4. { + There is appropriated to the Department of
Human Services, for the biennium beginning July 1, 2009, out of
the General Fund, the amount of $30 million to be deposited in
the Oregon Project Independence Fund established under ORS
410.422 for the purpose of carrying out the provisions of
sections 1 and 2 of this 2009 Act to be allocated as follows:
(1) $3.9 million for the central information center;
(2) $11.8 million for the staffing of the local assistance
centers;
(3) $10.5 million to expand the direct services provided in
Oregon Project Independence under ORS 410.420 and to provide
financial planning resources and volunteer services;
(4) $2.1 million to expand family caregiver support; and
(5) $1.7 million to establish programs for chronic disease
management and healthy living options counseling, resources and
services. + }
SECTION 5. { + Section 2 of this 2009 Act is repealed on
January 2, 2012. + }
SECTION 6. { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
