  Creates Task Force on Extending Washington County Commuter Rail
to Salem.
  Sunsets task force on date of convening of next regular
biennial legislative session.
 
                        A BILL FOR AN ACT
Relating to commuter rail.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) There is created the Task Force on
Extending Washington County Commuter Rail to Salem consisting of
17 members as follows:
  (a) One member who is the Representative of the Fifth
Congressional District of Oregon or the Representative's
designee.
  (b) Two members of the Senate, one of whom is a Democrat and
one of whom is a Republican, who shall be appointed by the
President of the Senate.
  (c) Two members of the House of Representatives, one of whom is
a Democrat and one of whom is a Republican, who shall be
appointed by the Speaker of the House of Representatives.
  (d) One member who is a representative of the Portland and
Western Railroad, and who shall be appointed by the Department of
Transportation. The department shall consider persons from a list
submitted to the department by the Portland and Western Railroad.
  (e) One member who is a representative of Tri-Met, as defined
in ORS 267.334, and who shall be appointed by the Tri-Met
governing body.
  (f) One member who is a representative of Washington County
government, and who shall be appointed by the Washington County
Board of Commissioners.
  (g) One member who is a representative of Marion County
government, and who shall be appointed by the Marion County Board
of Commissioners.
  (h) The administrator of the Rail Division of the Department of
Transportation.
  (i) The mayor of Beaverton or the designee of the mayor of
Beaverton.
  (j) The mayor of Wilsonville or the designee of the mayor of
Wilsonville.
  (k) The mayor of Keizer or the designee of the mayor of Keizer.
  (L) The mayor of Salem or the designee of the mayor of Salem.
  (m) One member who is a representative of the Salem Area Mass
Transit District, and who shall be appointed by the Cherriots
Board of Directors.
  (n) The mayor of Donald or the designee of the mayor of Donald.
  (o) The mayor of Woodburn or the designee of the mayor of
Woodburn.
  (2) The task force shall:
  (a) Explore the possibility of extending the Washington County
Commuter Rail from Wilsonville to Salem; and
  (b) Develop a program designed to generate interest and
activity in extending the commuter line.
  (3) The task force may:
  (a) Research the need for an extension of the Washington County
Commuter Rail;
  (b) Identify the actions that are necessary to extend the
Washington County Commuter Rail to Salem;
  (c) Evaluate the results of its findings under paragraphs (a)
and (b) of this subsection; and
  (d) Submit recommendations for legislation for presession
filing to an appropriate interim committee no later than October
1, 2010. All legislation recommended by official action of the
task force must indicate that it is introduced at the request of
the task force.
  (4) A majority of the members of the task force constitutes a
quorum for the transaction of business.
  (5) Official action by the task force requires the approval of
a majority of the members of the task force.
  (6) The task force shall elect one of its members to serve as
chairperson.
  (7) If there is a vacancy for any cause, the appointing
authority shall make an appointment to become immediately
effective.
  (8) The task force shall meet at times and places specified by
the call of the chairperson or of a majority of the members of
the task force.
  (9) The task force may adopt rules necessary for the operation
of the task force.
  (10) The task force shall report its findings and
recommendations to the Governor, the Speaker of the House of
Representatives and the President of the Senate in the manner
provided by ORS 192.245 no later than October 1, 2010.
  (11) The Legislative Administration Committee shall provide
staff support to the task force.
  (12) Notwithstanding ORS 171.072, members of the task force who
are members of the Legislative Assembly are not entitled to
mileage expenses or a per diem and serve as volunteers on the
task force. Other members of the task force are not entitled to
compensation or reimbursement for expenses and serve as
volunteers on the task force.
  (13) All agencies of state government, as defined in ORS
174.111, are directed to assist the task force in the performance
of its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the task force consider necessary to perform their
duties.
  (14) The task force shall have its first meeting no later than
60 days after the effective date of this 2009 Act. + }
  SECTION 2.  { + Section 1 of this 2009 Act is repealed on the
date of the convening of the next regular biennial legislative
session. + }
