  Modifies crime of sexual abuse in second degree to include
intentionally propelling dangerous substance at another
person { +  for purpose of arousing or gratifying sexual
desire + }.
 
                        A BILL FOR AN ACT
Relating to bodily fluids; creating new provisions; and amending
  ORS 163.425.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 163.425 is amended to read:
  163.425. (1) A person commits the crime of sexual abuse in the
second degree   { - when that - }  { +  if the + } person { + :
  (a) + } Subjects another person to sexual intercourse, deviate
sexual intercourse or, except as provided in ORS 163.412,
penetration of the vagina, anus or penis with any object other
than the penis or mouth of the actor and the victim does not
consent thereto { + ; or
  (b) For the purpose of arousing or gratifying the sexual desire
of the person or another person, intentionally propels any
dangerous substance at a victim who does not consent thereto + }.
  (2) Sexual abuse in the second degree is a Class C felony.
   { +  (3) As used in this section, 'dangerous substance' means
blood, urine, semen or feces. + }
  SECTION 2.  { + The amendments to ORS 163.425 by section 1 of
this 2009 Act apply to conduct occurring on or after the
effective date of this 2009 Act. + }
