SUMMARY

brief statement of the essential features of the measure as
introduced.
Directs Secretary of State to adopt electronic voting system to
allow certain long term absent electors to cast ballots
electronically.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to electronic voting system; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2009 Act is added to and made
a part of ORS chapter 253. + }
SECTION 2. { + (1) The Secretary of State by rule shall adopt
an electronic voting system to allow a long term absent elector
described in ORS 253.510 (1) or (2) to cast a ballot
electronically using the Internet. The Secretary of State may
utilize the voting assistance system administered by the United
States Department of Defense for electronic transmission of
election materials.
(2) The Secretary of State shall adopt rules governing the
procedures for receiving ballots cast under this section. + }
SECTION 3. { + The Secretary of State may take any action
before January 1, 2010, that is necessary to ensure that the
electronic voting system described in section 2 of this 2009 Act
is capable of receiving ballots cast electronically beginning on
January 1, 2010. + }
SECTION 4. { + Section 2 of this 2009 Act becomes operative on
January 1, 2010. + }
SECTION 5. { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
