AN ACT
Relating to elections.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2009 Act is added to and made
a part of ORS chapter 249. + }
SECTION 2. { + (1) If the county clerk determines that the
property indicated by the address information provided on a
nominating petition or declaration of candidacy for nomination or
election to the office of state Senator or state Representative
is located less than 100 radial yards from the boundary of the
district in which the candidate has filed for nomination or
election, the Secretary of State shall verify the location of the
residence of the candidate to determine whether the candidate is
an inhabitant of the district.
(2) The Legislative Administration Committee shall make
available to the secretary any mapping software and hardware used
by the Legislative Assembly for redistricting to aid the
secretary in verifying a candidate's residence under this
section. + }
SECTION 3. { + Section 2 of this 2009 Act applies to
candidates who file a nominating petition or declaration of
candidacy for nomination or election to the office of state
Senator or state Representative at an election held after the
first Tuesday after the first Monday in November, 2010. + }
