Authorizes governing body of county to establish moratorium on
tree cutting in residential or commercial areas while governing
body considers proposed ordinance limiting or prohibiting tree
cutting in area.
A BILL FOR AN ACT
Relating to a moratorium on tree cutting.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) If the governing body of a county
introduces a proposed ordinance that limits or prohibits tree
cutting in an area planned and zoned for residential or
commercial use, the governing body may, at introduction of the
proposed ordinance, impose a moratorium on tree cutting with
limits identical in scope and area to the limitations in the
proposed ordinance.
(2) A moratorium established under this section terminates on
the earliest of the following dates:
(a) A date certain that the governing body establishes when it
adopts the moratorium;
(b) The date on which the governing body gives final
consideration to the proposed ordinance if the governing body
rejects the ordinance, or the effective date of the proposed
ordinance if the governing body adopts the ordinance;
(c) The date on which the governing body tables the proposed
ordinance; or
(d) One year after the governing body introduces the proposed
ordinance.
(3) The governing body of a county may not impose another
moratorium under this section in the area to which a previous
moratorium applied within ___ years after the termination of the
previous moratorium. + }
SECTION 2. { + Section 1 of this 2009 Act applies to proposed
ordinances introduced by the governing body of a county on or
after the effective date of this 2009 Act. + }
