                             SUMMARY

  Prohibits employer from including residency pay differential in
wages or salaries of employees that is based on cities, counties
or states in which employees reside.
 
                        A BILL FOR AN ACT
Relating to pay differentials based on residency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2009 Act is added to and made
a part of ORS 653.010 to 653.261. + }
  SECTION 2.  { + (1) An employer may not employ two or more
individuals to perform the same work and pay wages or a salary
that includes a residency pay differential.
  (2) The Commissioner of the Bureau of Labor and Industries may
adopt rules to implement the provisions of subsection (1) of this
section.
  (3) As used in this section, 'residency pay differential '
means an addition to or deduction from the wages or salary of an
employee that is attributable to the city, county or state in
which the employee resides. + }
