  Allows landowner to request independent soil capability
assessment.
 
                        A BILL FOR AN ACT
Relating to soil information.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2009 Act is added to and made
a part of ORS chapter 215. + }
  SECTION 2.  { + (1) If a landowner wants to determine whether
land qualifies as agricultural land and needs more soil
information than that contained in the soil information database
created under ORS 215.209, the landowner may request that the
Department of Land Conservation and Development arrange for a
certified professional soil classifier registered in good
standing with the American Registry of Certified Professionals in
Agronomy, Crops and Soils to assess the capability of the
landowner's soil.
  (2) The department shall review the soil assessment made under
subsection (1) of this section.
  (3) The department shall charge the landowner a fee, in an
amount determined by the department by rule, for the soil
assessment and the department's review of the soil
assessment. + }
