Exempts small nonresidential uses from certain system
development charges for minor increases in impacts.
A BILL FOR AN ACT
Relating to system development charges.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2009 Act is added to and made
a part of ORS 223.297 to 223.314. + }
SECTION 2. { + (1) A local government may not assess a system
development charge for transportation, drainage or parks on an
existing nonresidential use that is increasing its impacts upon
transportation, drainage or parks by less than 25 percent if:
(a) The nonresidential use occupies a building or buildings
totaling less than 10,000 square feet in size; or
(b) The nonresidential use generates an average of fewer than
200 daily trips each weekday.
(2) If the increase of a nonresidential use described in
subsection (1)(a) or (b) of this section results in impacts upon
transportation, drainage or parks greater than 25 percent, the
local government may assess system development charges for the
impacts that are above 25 percent. + }
