SUMMARY

Directs Oregon Department of Administrative Services to
establish Construction Greenhouse Gas Emissions and Economic
Development Pilot Program. Specifies projects to be included in
program. Allows department to contract with construction
companies to implement pilot program. Specifies requirements for
construction companies. Requires Construction Greenhouse Gas
Emissions and Economic Development Assessment Report to be
completed for projects included in pilot program.
Requires department to submit report regarding pilot program to
Legislative Assembly.
Sunsets program January 2, 2014.
A BILL FOR AN ACT
Relating to construction greenhouse gas emissions pilot program.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Oregon Department of Administrative
Services shall establish a pilot program in order to create jobs
and to gain a better understanding of the nature of greenhouse
gas emissions associated with capital improvement projects of at
least $10 million. This program shall be known as the
Construction Greenhouse Gas Emissions and Economic Development
Pilot Program.
(2) The pilot program established under this section must
include a variety of projects that:
(a) Identify ways in which reducing greenhouse gas emissions
may promote local economic development, create local jobs and
provide training opportunities;
(b) Identify specific opportunities to create green-collar jobs
through greenhouse gas analysis connected to all aspects of the
construction process;
(c) Gather data that are useful for the development of
construction strategies that are meant to lower greenhouse gas
emissions and promote local economies through construction
projects and practices;
(d) Identify the amount of greenhouse gas emissions that are
associated with the transportation of materials and workers
commonly used in construction projects;
(e) Help identify the major materials common to various types
of construction projects, as well as the greenhouse gases
associated with the manufacture and transportation of each major
material;
(f) Develop short-term and long-term strategies to reduce
greenhouse gas emissions associated with the construction
industry;
(g) Identify any no-cost and low-cost opportunities to reduce
greenhouse gas emissions in the short term;
(h) Support local efforts to develop businesses and
technologies that promote the understanding, management and
reduction of greenhouse gas emissions throughout Oregon; and
(i) Enhance Oregon's position as a leader in green construction
projects.
(3) Projects under subsection (2) of this section must include
capital improvement projects related to state office buildings,
storage buildings, industrial buildings, manufacturing buildings,
utility projects, prisons, roads and bridges.
(4)(a) The department may contract with construction companies
to implement the pilot program established under this section.
(b) Any construction company with which the department
contracts must:
(A) Have experience in developing and managing individual
construction projects in Oregon that have a value of at least $10
million;
(B) Have developed at least one Leadership in Energy and
Environmental Design project that has achieved Gold
certification;
(C) Have at least one staff member who will work on the project
who holds Leadership in Energy and Environmental Design
professional accreditation or who has expertise as a sustainable
building adviser;
(D) Have at least one member who will work on the project who
holds a current Oregon construction contractor license;
(E) Have experience measuring the greenhouse gas emissions of
projects similar to those projects included in the pilot program
established under this section; and
(F) Follow any applicable recommendations of the World Business
Council for Sustainable Development, or World Resources
Institute, related to greenhouse gas emissions.
(5) The department may adopt any rules necessary to implement
the pilot program established under this section.
(6) A Construction Greenhouse Gas Emissions and Economic
Development Assessment Report must be completed for each project
carried out under the pilot program established under this
section. The report must identify any opportunities to enhance
local economic development, local investment and the potential
for green-collar jobs. In addition, the report must:
(a) Analyze the major components of the project, including but
not limited to materials transport and site logistics, and
determine the greenhouse gas emissions connected with each
component;
(b) Identify local economic development programs that may be
enhanced through involvement with the project;
(c) Identify opportunities to create green-collar jobs through
the analysis and management of greenhouse gas emissions related
to the construction process;
(d) Quantify and qualify the competitive environment for the
major components of the project; and
(e) Identify any major environmental impacts from the project
and provide conceptual strategies to reduce significant
environmental impacts from transportation connected to the
project. + }
SECTION 2. { + No later than February 1, 2013, the Oregon
Department of Administrative Services shall submit a report
regarding the pilot program conducted under section 1 of this
2009 Act, and may include recommendations for legislation, to the
Legislative Assembly in the manner provided by ORS 192.245. + }
SECTION 3. { + Section 1 of this 2009 Act is repealed on
January 2, 2014. + }
