SUMMARY

Appropriates moneys from General Fund to Department of
Corrections for certain biennial expenses.
Limits certain biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by department.
Limits biennial expenditures by department from federal funds.

appropriations from General Fund to department.
Increases, for biennium ending June 30, 2009, appropriations
from General Fund to department for community corrections. + }

A BILL FOR AN ACT
Relating to financial administration of the Department of
Corrections; appropriating money; limiting expenditures; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + There are appropriated to the Department of
Corrections, for the biennium beginning July 1, 2009, out of the
General Fund, the following amounts for the following

expenditures, the following amounts are established for the
biennium beginning July 1, 2009, as the maximum limits for
payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Department of
Corrections, for the following purposes: + }

SECTION 3. { + Notwithstanding any other law limiting
expenditures, the amount of $108,541,761 is established for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses from federal funds collected or received by the
Department of Corrections for operations. + }
SECTION 4. { + Notwithstanding any other provision of law, the
General Fund appropriation made to the Department of Corrections
for administration, public services, general services and human
resources established by section 1 (2), chapter 594, Oregon Laws
2007, for the biennium ending June 30, 2009, is reduced by
$1,422,689. + }
SECTION 5. { + Notwithstanding any other provision of law, the
General Fund appropriation made to the Department of Corrections
for community corrections established by section 1 (4), chapter
594, Oregon Laws 2007, for the biennium ending June 30, 2009, is
increased by $1,500,000. + }
SECTION 6. { + Notwithstanding any other provision of law, the
General Fund appropriation made to the Department of Corrections
for debt service established by section 1 (5), chapter 594,
Oregon Laws 2007, for the biennium ending June 30, 2009, is
reduced by $77,311. + }
SECTION 7. { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
