                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Directs school district to ensure that football helmets be
annually inspected and to replace all helmets within 10 years.
Prohibits use of football helmets that do not meet standards
adopted by State Board of Education.
  Requires coaches of interscholastic football teams to receive
annual training on how to recognize symptoms of concussion and
how to seek proper medical treatment for person suspected of
having concussion.
  Declares emergency, effective July 1, 2009.
 
                        A BILL FOR AN ACT
Relating to safety of school sports; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Each school district shall ensure that
football helmets that are available to students at schools of the
district for use in interscholastic football be annually
inspected and meet standards adopted by the State Board of
Education by rule.
  (2) If a football helmet does not meet the standards adopted
under subsection (1) of this section, the school district shall
immediately cause the helmet to no longer be available for use.
  (3) A school district shall replace all football helmets
available for use by students participating in interscholastic
football within 10 years of first being available for use,
regardless of whether the helmets meet the standards adopted
under subsection (1) of this section. + }
  SECTION 2.  { + (1) A school district shall first conduct an
annual inspection described in section 1 of this 2009 Act prior
to the beginning of the 2010-2011 school year.
  (2) Notwithstanding the requirement to replace all football
helmets within 10 years under section 1 (3) of this 2009 Act, a
school district that has football helmets on the effective date
of this 2009 Act for which the district is unable to determine
when the football helmets first were available for use, must
replace all of those football helmets by July 1, 2019. + }
  SECTION 3.  { + (1) As used in this section, 'coach' means a
person who instructs or trains members of an interscholastic
football team, as identified by criteria established by the State
Board of Education by rule.
 
  (2) Each school district shall ensure that coaches receive
annual training to learn how to recognize the symptoms of a
concussion and how to seek proper medical treatment for a person
suspected of having a concussion.
  (3) The board shall establish by rule the requirements of the
training described in subsection (2) of this section and
timelines to ensure that, to the extent practicable, all coaches
receive the training before an interscholastic football season
begins. + }
  SECTION 4.  { + Section 3 of this 2009 Act first applies to
school districts that have interscholastic football coaches for
interscholastic football seasons that begin during or after the
2010-2011 school year. + }
  SECTION 5.  { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect July 1,
2009. + }
