                             SUMMARY

brief statement of the essential features of the measure as
introduced.
 
  Directs Department of Education to seek federal funds for
purpose of funding pilot projects that implement physical
activity and learning programs.
  Requires department to report to Seventy-sixth Legislative
Assembly.
  Declares emergency, effective July 1, 2009.
 
                        A BILL FOR AN ACT
Relating to physical education; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Department of Education shall seek
federal funds for the purpose of funding pilot projects that
implement physical activity and learning programs.
  (2) For the purpose of funding pilot projects described in
subsection (1) of this section, the department may accept
contributions of funds and assistance from the United States
Government and its agencies or from any other source, public or
private, and agree to conditions placed on funds not inconsistent
with the purpose of promoting pilot projects described in
subsection (1) of this section.
  (3) All funds received by the department under this section
shall be paid into the Department of Education Account
established in ORS 326.115 to the credit of the department for
the purpose of this section. + }
  SECTION 2.  { + The Department of Education shall report to the
Seventy-sixth Legislative Assembly in the manner described in ORS
192.245 regarding:
  (1) Funding applied for and received under section 1 of this
2009 Act; and
  (2) Pilot projects funded as provided under section 1 of this
2009 Act. + }
  SECTION 3.  { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect July 1,
2009. + }
