A BILL FOR AN ACT
Relating to reductions in funding of health services;
appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Department of Human Services shall
develop and implement a plan for providing emergency services to
senior citizens and persons with disabilities who receive
services through the department during the biennium beginning
July 1, 2007, and who lose services due to reductions in funding
during the biennium beginning July 1, 2009. This subsection
applies to:
(a) Residents of long term care facilities as defined in ORS
442.015.
(b) Residents of residential care facilities as defined in ORS
443.400.
(c) Individuals who receive home- and community-based services.
(2) The emergency services provided under this section shall be
coordinated by area agencies.
(3) The department shall maintain records on individuals
described in subsection (1) of this section in order to create a
study, in collaboration with area agencies, of the impact of the
termination or reduction in services on such individuals. The
department shall contract with a private entity or individual to
conduct the study, which must include findings on all of the
following:
(a) Adequacy of care received.
(b) Changes in the individuals' level of impairment or service
priority level classification.
(c) Admissions of the individuals to skilled nursing facilities
or intermediate care facilities.
(4) The department shall report to the appropriate interim
committee of the Legislative Assembly no later than November 1,
2010, on the provision of emergency services under subsection (1)
of this section and on the findings of the study described in
subsection (3) of this section. The report shall include
recommendations for the restoration of funding of long term care
facilities, residential care facilities and home- and
community-based services. + }
SECTION 2. { + There is appropriated to the Department of
Human Services, for the biennium beginning July 1, 2009, out of
the General Fund, the amount of $_______ for the purpose of
carrying out the provisions of section 1 of this 2009 Act. + }
SECTION 3. { + Section 1 of this 2009 Act is repealed on
January 2, 2012. + }
SECTION 4. { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
