Prohibits future adoption, enactment or creation of homeowners
association rules or private covenants, conditions, restrictions
or other agreements that prohibit installation and use of
renewable energy devices.
A BILL FOR AN ACT
Relating to renewable energy devices.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section, 'renewable energy
device' means:
(a) A solar panel or other device for obtaining energy from
solar, wind or other renewable resources; or
(b) A clothesline or other device that uses solar, wind or
other renewable energy resources to accomplish household tasks.
(2) A homeowners association rule or a private covenant,
condition, restriction or other agreement limiting the rights of
residential property owners may not prohibit the installation or
use of a renewable energy device on the residential property.
(3) This section does not apply to a homeowners association
rule or private covenant, condition, restriction or other
agreement adopted, enacted or created before the effective date
of this 2009 Act. + }
