                             SUMMARY

  Appropriates moneys from General Fund to Department of
Education for purpose of awarding grants to school districts and
public charter schools for physical education { +  and any
conditioning provided as part of physical education program + }.
  Declares emergency, effective July 1, 2009.
 
                        A BILL FOR AN ACT
Relating to physical education; appropriating money; and
  declaring an emergency.
  Whereas obesity is a major health risk factor linked to
increased cardiovascular disease, cancer, diabetes and early
death, and obese children are more likely to be diagnosed with
diabetes, high blood pressure, mental health problems, bone and
joint disorders and other health problems that require costly
treatment; and
  Whereas one in three children born in the United States will
develop Type II diabetes during the child's lifetime, and one in
two children from ethnic minority groups will develop Type II
diabetes; and
  Whereas one in four Oregon children are overweight or obese,
and obese children use health care services more often than
nonobese children; and
  Whereas the Centers for Disease Control and Prevention
considers a national health objective for 2010 to be to increase
the number of students who participate in physical education; and
  Whereas regular physical activity helps develop stronger bones
and muscles, reduces feelings of depression and anxiety and
promotes psychological well-being; and
  Whereas a recent study shows that physically fit children
perform better academically; now, therefore,
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Education, for the biennium beginning July 1, 2009, out of the
General Fund, the amount of $_______ for the purpose of awarding
grants to school districts and public charter schools for
physical education as established by ORS 329.501 and any
 
conditioning provided as part of a physical education
program. + }
  SECTION 2.  { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect July 1,
2009. + }
