  Authorizes insurer to pay  { + cash + } dividends   { - in form
of cash rewards - }  to enrollees who participate in approved

to Director of Department of Consumer and Business Services.
Requires director to report to Seventy-seventh and Seventy-eighth
Legislative Assemblies on long term effectiveness of paying
dividends to encourage healthy lifestyles. - }
 
                        A BILL FOR AN ACT
Relating to health benefit plan dividends paid for healthy
  lifestyles.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2009 Act is added to and made
a part of the Insurance Code. + }
  SECTION 2.  { + (1) As used in this section, 'healthy behaviors
' means participating in constructive behaviors that encourage
fitness, healthy eating and other activities that are beneficial
to good health.
  (2) An insurer offering a health benefit plan, as defined in
ORS 743.730, may pay cash dividends to enrollees in the plan who
participate in a program approved by the insurer that promotes
healthy behaviors.
  (3) Dividends paid pursuant to this section are not premium
variations for the purposes of ORS 743.767. + }
  SECTION 3.  { + Section 2 of this 2009 Act applies to health
benefit plans offered or renewed on or after the effective date
of this 2009 Act. + }
