brief statement of the essential features of the measure as
introduced.
 
  Requires Multnomah County to sell Wapato Jail facilities to
Department of Corrections upon department's request.
  Appropriates moneys from General Fund to Department of
Corrections to purchase jail.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to Wapato Jail; appropriating money; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Upon the request of the Department of
Corrections, Multnomah County shall sell the Wapato Jail
facilities to the department.
  (2) Multnomah County and the department must complete
negotiations for sale of the jail within 90 days after the
effective date of this 2009 Act.
  (3) If the parties do not come to an agreement within the
negotiation period, the Chief Justice of the Supreme Court shall
appoint a master to determine fair terms for the sale.
  (4) The master must make a determination of the fair terms
within 120 days after being appointed.
  (5) Notwithstanding any other provision of state or local law,
the department may operate the jail as a state correctional
facility. + }
  SECTION 2.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Corrections, for the biennium beginning July 1, 2009, out of the
General Fund, the amount of $1 for the purpose of purchasing the
Wapato Jail facilities from Multnomah County. + }
  SECTION 3.  { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
