  Encourages contracting agencies to use emergency procurement
methods for capital construction projects in biennium beginning
July 1, 2007. Sunsets January 2, 2012.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to emergency procurement for financed capital
  construction projects; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Legislative Assembly finds and declares
that:
  (a) Job creation and retention is needed at this time to
provide stimulus to the Oregon economy; and
  (b) The economic circumstances justify a determination by the
head of a contracting agency, or a person designated under ORS
279A.075, that an emergency exists and that the use of emergency
procurement authority granted by ORS 279B.080 is warranted.
  (2) For authorized capital construction projects, all or part
of which are financed through general obligation bonds, revenue
bonds, certificates of participation and other financing
agreements to be issued and sold in the biennium beginning July
1, 2007, the Legislative Assembly encourages the use of emergency
procurement procedures and directs that, in the use of emergency
procurement procedures, a contracting agency shall use:
  (a) Methods that ensure fairness;
  (b) Only legal, responsible contractors;
  (c) When practicable, companies located in Oregon and products
manufactured in Oregon; and
  (d) When practicable, minority, women and emerging small
business enterprises certified under ORS 200.055 as service and
product providers. + }
  SECTION 2.  { + Section 1 of this 2009 Act is repealed on
January 2, 2012. + }
  SECTION 3.  { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2009 Act takes effect on its
passage. + }
