brief statement of the essential features of the measure as
introduced.
 
  Limits use of commercial tanning devices by children who are 14
to 18 years of age. Prohibits use of commercial tanning devices
by children under 14 years of age, unless authorized by
physician.
 
                        A BILL FOR AN ACT
Relating to tanning devices.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2009 Act is added to and made
a part of ORS 431.925 to 431.955. + }
  SECTION 2.  { + (1)(a) A child who is at least 14 years of age
but less than 18 years of age may not use a tanning device at a
tanning facility unless:
  (A) The parent or legal guardian of the child signs a document
declaring that the signatory is the parent or legal guardian of
the child, attesting to the legal age of the child and consenting
to the child's use of the tanning device;
  (B) The parent or legal guardian is present at the tanning
facility during the child's initial use of the tanning device;
and
  (C) An operator is present at all times the child uses the
tanning device.
  (b) The consent of the parent or legal guardian of the child is
valid for 12 uses of the tanning device by the child, unless
revoked in writing by the parent or legal guardian.
  (c) A person's driver license or other government-issued
identification provides adequate proof under this subsection that
a person is at least 18 years of age, if the identification
contains the name, the date of birth and a photograph of the
person.
  (2) A child under the age of 14 years may not use a tanning
device at a tanning facility without a written order from a
physician licensed under ORS chapter 677. A child using a tanning
device under this subsection must be accompanied by a parent or
legal guardian each time the child uses the tanning device. + }
