A BILL FOR AN ACT
Relating to payment for health care services provided to
enrollees of prepaid managed care health services organization.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section:
(a) 'Community health center or safety net clinic' means a
nonprofit medical clinic or school-based health center that
provides primary physical health, vision, dental or mental health
services to low-income patients without charge or using a sliding
scale based on the income of the patient.
(b) 'Medical assistance' has the meaning given that term in ORS
414.025.
(c) 'Prepaid managed care health services organization' has the
meaning given that term in ORS 414.736.
(2) A prepaid managed care health services organization shall
contract with a community health center or safety net clinic for
the provision of covered services by the center or clinic to an
enrollee of the organization who is a recipient of medical
assistance if the center or clinic providers are credentialed by
the organization and agree to contractual terms, conditions and
reimbursement rates similar to those negotiated by the
organization with subcontractors providing the same or similar
services.
(3) The Department of Human Services shall adopt standards by
rule for the contracts entered into between centers or clinics
and organizations under this section. + }
SECTION 2. { + Section 1 of this 2009 Act applies to contracts
entered into or renewed between the Department of Human Services
and a prepaid managed care health services organization on or
after the effective date of this 2009 Act. + }
