SUMMARY

brief statement of the essential features of the measure as
introduced.
Authorizes existing model railroad that is one-third scale or
smaller as outright permitted use of land zoned for forest use or
mixed farm and forest use. Authorizes inspection of use to ensure
safety of users of model railroad and protection of riparian
lands.
Sunsets January 2, 2015.
A BILL FOR AN ACT
Relating to a model railroad on resource land.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) A model railroad and all related structures
are an outright permitted use of land zoned for forest use or
mixed farm and forest use if the model railroad:
(a) Is one-third scale or smaller;
(b) Is operated without an admission fee on an invitation-only
basis for 50 or fewer people at a time as a hobby; and
(c) Was established on or before January 1, 2009.
(2) The use allowed under this section may not be disallowed
for failure of the property owner to obtain state or local
government permits or approval, including but not limited to
building permits, riparian modification or restoration permits
and permits for the operation of an amusement ride. However, a
model railroad and all related structures allowed under this
section are subject to inspection for purposes of:
(a) Determining that structures are in compliance or can be
brought into compliance with building code requirements;
(b) Reviewing riparian modification and restoration already
accomplished and determining whether additional riparian
restoration is needed; and
(c) Determining that structures are in compliance with or can
be brought into compliance with fire safety requirements. + }
SECTION 2. { + Section 1 of this 2009 Act is repealed January
2, 2015. + }
