AN ACT
Relating to financial administration of the Department of Human
Services; appropriating money; limiting expenditures; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + There are appropriated to the Department of
Human Services, for the biennium beginning July 1, 2009, out of
the General Fund, the following amounts for the following

SECTION 2. { + Notwithstanding any other law limiting
expenditures, the following amounts are established for the
biennium beginning July 1, 2009, as the maximum limits for
payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, tobacco tax receipts and
Medicare receipts and including federal funds for indirect cost
recovery, Social Security Supplemental Security Income
recoveries, the Child Care and Development Fund, the Women,
Infants and Children Program food rebates, the Coordinated School
Health Program, Edward Byrne Memorial State and Local Law
Enforcement Assistance, homeland security and emergency
preparedness and response services, but excluding lottery funds

and federal funds not described in this section, collected or
received by the Department of Human Services, for the following

SECTION 3. { + Notwithstanding any other law limiting
expenditures, the amount of $11,591,376 is established for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses from lottery moneys allocated from the Administrative
Services Economic Development Fund to the Department of Human
Services for gambling addiction treatment and prevention. + }
SECTION 4. { + Notwithstanding any other law limiting
expenditures, the following amounts are established for the
biennium beginning July 1, 2009, as the maximum limits for
payment of expenses from federal funds, excluding federal funds
described in section 2 of this 2009 Act, collected or received by
the Department of Human Services, for the following purposes: + }

SECTION 5. { + For the biennium beginning July 1, 2009,
expenditures by the Department of Human Services for Women,
Infants and Children Program food vouchers and federal food stamp
benefit payments are not limited. + }
SECTION 6. { + Notwithstanding any other provision of law, the
General Fund appropriation made to the Department of Human
Services by section 1 (3), chapter 743, Oregon Laws 2007, for
Health Services, for the biennium ending June 30, 2009, as
modified by Emergency Board action or the Legislative Assembly,
is increased by $6,067,000. + }
SECTION 7. { + This 2009 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency

is declared to exist, and this 2009 Act takes effect on its
passage. + }
