SENATE MINORITY REPORT
AMENDMENTS TO
SENATE BILL 1032

President Courtney:
A minority of your Committee on Environment and Natural
Resources, to whom was referred Senate Bill 1032, having had the
same under consideration, respectfully reports it back with the
recommendation that it do pass with the following amendments:
On page 1 of the printed bill, line 2, after 'provisions; '
delete the rest of the line and line 3 and insert 'and amending
ORS 646.608.'.
Delete lines 5 through 17 and insert:
' { + SECTION 1. + } { + (1) As used in this section:
' (a) 'Child beverage container' means any empty baby bottle or
spill-proof cup that is:
' (A) Distributed or sold at retail without containing any
liquid, food, beverage or other contents;
' (B) Designed to be filled with liquid; and
' (C) Primarily intended by the manufacturer for use by a child
three years of age or younger.
' (b) 'Person' has the meaning given that term in ORS 646.605.
' (2) A person may not willfully or knowingly manufacture,
distribute, sell or offer for sale at retail in this state any
child beverage container made or lined with bisphenol A. + } ' .
On page 4, delete lines 24 through 28 and insert:
' { + SECTION 3. + } { + (1) Section 1 of this 2010 Act and
the amendments to ORS 646.608 by section 2 of this 2010 Act
become operative on the day after the date on which the
Legislative Counsel receives notice from the Oregon Health
Authority that the United States Food and Drug Administration has
adopted regulations providing that child beverage containers as
defined in section 1 of this 2010 Act may not be made or lined
with bisphenol A.
' (2) The Oregon Health Authority shall notify the Legislative
Counsel immediately upon the adoption of regulations by the
United States Food and Drug Administration providing that child
beverage containers as defined in section 1 of this 2010 Act may
not be made or lined with bisphenol A. + } ' .
