Chapter 96 Oregon Laws 2010 Special Session

AN ACT

HB 5101

Relating to state financial administration; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

SECTION 1. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Business Development Department established by section 3 (1), chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $336,778.

SECTION 2. (1) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Business Development Department established by section 3 (5), chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $2,079,041.

          (2) Notwithstanding section 18, chapter 905, Oregon Laws 2009, the amount established by section 18 (2)(b)(A), chapter 905, Oregon Laws 2009, is decreased by $2,079,041.

SECTION 3. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Education established by section 4, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $29,980,328.

SECTION 4. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Problem Gambling Treatment Fund established by section 6, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $653,972.

SECTION 5. (1) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Housing and Community Services Department established by section 9a, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $161,246.

          (2) Notwithstanding section 18, chapter 905, Oregon Laws 2009, the amount established by section 18 (2)(b)(C), chapter 905, Oregon Laws 2009, is decreased by $161,246.

SECTION 6. (1) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 10, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $1,555.

          (2) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 11, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $213,545.

          (3) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 37, chapter 885, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $215,100.

SECTION 7. (1) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Community Colleges and Workforce Development established by section 13a, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $73,698.

          (2) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Department of Community Colleges and Workforce Development established by section 13b, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $376,500.

          (3) Notwithstanding section 18, chapter 905, Oregon Laws 2009, the amount established by section 18 (2)(b)(H), chapter 905, Oregon Laws 2009, is decreased by $450,198.

SECTION 8. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the office of the Governor established by section 14, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $72,315.

SECTION 9. Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 16, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $3,270,834.

SECTION 10. (1) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the State Forestry Department established by section 17a, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $133,465.

          (2) Notwithstanding section 18, chapter 905, Oregon Laws 2009, the amount established by section 18 (2)(b)(J), chapter 905, Oregon Laws 2009, is decreased by $133,465.

SECTION 11. (1) Notwithstanding any other law allocating moneys from the Administrative Services Economic Development Fund, the allocation to the Oregon Department of Administrative Services established by section 17c, chapter 905, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $156,951.

          (2) Notwithstanding section 18, chapter 905, Oregon Laws 2009, the amount established by section 18 (2)(b)(D), chapter 905, Oregon Laws 2009, is decreased by $156,951.

SECTION 12. Notwithstanding any other law allocating moneys from the Criminal Fine and Assessment Account, the allocation to the Department of Public Safety Standards and Training established by section 3 (1), chapter 861, Oregon Laws 2009, for the biennium beginning July 1, 2009, is decreased by $1,800,000.

SECTION 13. (1) Notwithstanding ORS 461.558 and except as provided in subsection (2) of this section, for the biennium beginning July 1, 2009, the amount of the lottery ending balance transferred as provided in ORS 461.558 to the school capital matching subaccount created within the Education Stability Fund by section 4 (8), Article XV of the Oregon Constitution, shall be an amount equal to the greater of:

          (a) The difference between the lottery ending balance and the total amount of the decreases in allocations made by sections 1 to 11 of this 2010 Act; or

          (b) Zero.

          (2) For purposes of subsection (1) of this section, the decreases in allocations made by sections 1 to 11 of this 2010 Act do not include the decrease made by section 6 (3) of this 2010 Act.

SECTION 14. This 2010 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2010 Act takes effect on its passage.
