Chapter 3 Oregon Laws 2011

 

AN ACT

 

HB 3339

 

Relating to state financial administration; creating new provisions; amending section 4, chapter 104, Oregon Laws 2010; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. The allotment reductions adopted by the Oregon Department of Administrative Services on September 21, 2010, as temporary administrative rule 122-060-0040, shall remain in effect for the remainder of the biennium ending June 30, 2011.

 

          SECTION 2. Notwithstanding ORS 56.041, the amount of $745,548 is transferred from the Operating Account to the General Fund for general governmental purposes.

 

          SECTION 3. Notwithstanding section 7, chapter 710, Oregon Laws 2009, the amount of $12,000,000 is transferred from the Tax Amnesty Fund to the General Fund for general governmental purposes.

 

          SECTION 4. Notwithstanding ORS 414.815, the amount of $500,000 is transferred from the Law Enforcement Medical Liability Account to the Department of Human Services Account established in ORS 409.060.

 

          SECTION 5. (1) Notwithstanding any other provision of law, the amount of $2,484 is transferred from moneys allocated to the Legislative Fiscal Officer by section 17, chapter 107, Oregon Laws 2010, to the Judicial System Surcharge Account established under section 1, chapter 659, Oregon Laws 2009, for distribution to the Judicial Department and the Public Defense Services Commission.

          (2) Section 17 (2), chapter 107, Oregon Laws 2010, does not apply to the distribution by the Department of Revenue from the Judicial System Surcharge Account of moneys described in subsection (1) of this section.

 

          SECTION 6. (1) Notwithstanding any other provision of law, the amount of $37,769 is transferred from moneys allocated to the Legislative Administration Committee by section 17, chapter 107, Oregon Laws 2010, to the Judicial System Surcharge Account established under section 1, chapter 659, Oregon Laws 2009, for distribution to the Judicial Department and the Public Defense Services Commission.

          (2) Section 17 (2), chapter 107, Oregon Laws 2010, does not apply to the distribution by the Department of Revenue from the Judicial System Surcharge Account of moneys described in subsection (1) of this section.

 

          SECTION 7. Section 4, chapter 104, Oregon Laws 2010, is amended to read:

          Sec. 4. (1) The Supplemental School District and School Program Subaccount is established within the State School Fund. The Department of Education shall maintain separate records for moneys in the subaccount.

          (2) The Supplemental School District and School Program Subaccount consists of moneys appropriated to the subaccount as provided by sections 8 and 9, chapter 635, Oregon Laws 2009, [and] moneys transferred to the subaccount as provided by section 5 [of this 2010 Act], chapter 104, Oregon Laws 2010, and moneys allocated to the subaccount by the Emergency Board.

          (3) Moneys in the Supplemental School District and School Program Subaccount are continuously appropriated to the Department of Education for distribution as provided by section 7 [of this 2010 Act], chapter 104, Oregon Laws 2010.

 

          SECTION 8. The transfers described in sections 2 to 6 of this 2011 Act shall be made on or before June 30, 2011.

 

          SECTION 9. This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect on its passage.
