Relating to
charges assessed by the Oregon Business Development Department; creating new
provisions; and amending ORS 285A.200.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 285A.200 is amended to
read:
285A.200. (1) The Oregon Business
Development Department may accept gifts of money or other property from any
public or private agency or person made for the purpose of assisting the
department to carry out any programs or laws that the department is charged
with administering. Moneys so received shall be paid into an appropriate fund
or account. Property so received shall be used for the purposes for which that
property is given.
(2) The department may apply for,
receive from the United States or any of its agencies, and disburse or
supervise the disbursement of federal aid for the purposes for which the aid is
provided. The department may also disburse or supervise the disbursement of
funds provided by the State of Oregon for expenditure as a condition of
receiving the federal aid.

The department may assess and charge fees for loans made from any of its funds
or accounts.]
(3) The department may assess and
charge fees:
(a) For loans made from any of its
funds or accounts; and
(b) For program benefits provided and
administrative expenses incurred by the department in the administration of the
process developed in accordance with ORS 284.565 to certify sites that are
ready for industrial or traded sector development.
SECTION 2. The amendments to ORS
285A.200 by section 1 of this 2011 Act apply to administrative expenses
incurred and program benefits provided by the Oregon Business Development
Department on or after the effective date of this 2011 Act.
