Chapter 409 Oregon Laws 2011

 

AN ACT

 

HB 5002

 

Relating to the financial administration of the State Department of Agriculture; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There are appropriated to the State Department of Agriculture, for the biennium beginning July 1, 2011, out of the General Fund, the following amounts, of which the department may expend up to 54 percent during the period beginning July 1, 2011, and ending June 30, 2012, for the following purposes:

 

      (1)    Administrative and support

              services                                           $ 816,397

      (2)    Food safety                                    $ 5,277,489

      (3)    Natural resources                         $ 3,065,681

      (4)    Agricultural development            $ 3,451,049

 

          SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2011, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, and including federal funds for contract services, but excluding lottery funds and federal funds not described in this section, collected or received by the State Department of Agriculture, for the following purposes:

 

      (1)    Administrative and support

              services                                           $ 8,873,594

      (2)    Food safety                                    $ 18,476,681

      (3)    Natural resources                         $ 13,537,783

      (4)    Agricultural development            $ 11,244,690

 

          SECTION 3. Notwithstanding any other law limiting expenditures, the amount of $6,335,856 is established for the biennium beginning July 1, 2011, as the maximum limit for payment of expenses from lottery moneys allocated from the Parks and Natural Resources Fund to the State Department of Agriculture for the Oregon Plan, to be used for fish and watershed activities.

 

          SECTION 4. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2011, as the maximum limits for payment of expenses from federal funds other than those described in section 2 of this 2011 Act collected or received by the State Department of Agriculture, for the following purposes:

 

      (1)    Food safety                                    $ 972,513

      (2)    Natural resources                         $ 5,097,098

      (3)    Agricultural development            $ 5,876,267

 

          SECTION 5. Notwithstanding any other law limiting expenditures, the amount of $20,158 is established for the biennium beginning July 1, 2011, as the maximum limit for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the State Department of Agriculture for deposit in the County Fair Account established in ORS 565.445, to support county fairs.

 

          SECTION 6. This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect July 1, 2011.
