AN ACT
HB 3451
Relating to
the McKenzie River Subbasin; appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) The Task Force on
the McKenzie River Subbasin is established. The task force shall consist of
seven to ten members to be appointed by the Governor and shall represent the
diversity of persons with a stakeholding interest in the McKenzie River. There
shall be at least:
(a) One member who represents local
economic interests;
(b) One member who is a local expert
on the McKenzie River Subbasin;
(c) One member who represents local
commercial use of the McKenzie River; and
(d) One member who represents local
recreational use of the McKenzie River.
(2) The task force shall prepare a set
of proposals related to the State Department of Fish and Wildlife’s
implementation in the McKenzie River Subbasin of strategies specified in the
Upper Willamette River Conservation and Recovery Plan for Chinook Salmon and
Steelhead.
(3) A majority of the voting members
of the task force constitutes a quorum for the transaction of business.
(4) Official action by the task force
requires the approval of a majority of the voting members of the task force.
(5) The task force shall elect one of
its members to serve as chairperson.
(6) If there is a vacancy for any
cause, the appointing authority shall make an appointment to become immediately
effective.
(7) The task force shall meet at times
and places specified by the call of the chairperson or of a majority of the
voting members of the task force.
(8) The task force may adopt rules
necessary for the operation of the task force.
(9) The task force shall submit a
report, and may include recommendations for legislation, to the interim
committees of the Legislative Assembly related to fish and wildlife no later
than October 1, 2012.
(10) The Legislative Administration
Committee, through the Legislative Administrator, shall provide staff support
to the task force.
(11) Members of the task force are not
entitled to compensation, but may be reimbursed for actual and necessary travel
and other expenses incurred by them in the performance of their official duties
in the manner and amounts provided for in ORS 292.495 until moneys are no
longer available for that purpose. Claims for expenses shall be paid out of the
McKenzie River Subbasin Fund established under section 2 of this 2011 Act.
(12) Any agency of state government,
as defined in ORS 174.111, may assist the task force in the performance of its
duties and, to the extent permitted by laws relating to confidentiality, shall
furnish such information and advice as the members of the task force consider
necessary to perform their duties.
SECTION 2. (1) The McKenzie River
Subbasin Fund is established in the State Treasury, separate and distinct from
the General Fund. Interest earned by the McKenzie River Subbasin Fund shall be
credited to the fund. Moneys in the fund are continuously appropriated to the
Legislative Administration Committee to provide staff support to the Task Force
on the McKenzie River Subbasin described in section 1 of this 2011 Act.
(2) The task force may accept grants,
donations, contributions or gifts from any source for deposit in the fund
established in subsection (1) of this section for the purpose of enabling the
task force to carry out the actions required by section 1 of this 2011 Act,
including for the purposes of:
(a) Hiring a mediator to assist the
task force in coming to a consensus on the proposals to be prepared pursuant to
section 1 (2) of this 2011 Act; and
(b) Reimbursing actual and necessary
travel and other expenses incurred by the members of the task force in the
performance of their official duties pursuant to section 1 (11) of this 2011
Act.
SECTION 3. (1) Section 1 of this
2011 Act is repealed on January 2, 2014.
(2) The McKenzie River Subbasin Fund
established under section 2 of this 2011 Act is abolished on January 2, 2014.
(3) Any unexpended moneys remaining in
the McKenzie River Subbasin Fund on January 2, 2014, shall be transferred to
the General Fund.
SECTION 4. This 2011 Act being
necessary for the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2011 Act takes effect on its
passage.
